A RESOLUTION APPROVING THE APPLICATION FOR GRANT FUNDS
FROM THE ROBERTI-Z'BERG-HARRIS URBAN OPEN SPACE AND
RECREATION PROGRAM UNDER THE SAFE NEIGHBORHOOD
PARKS, CLEAN WATER, CLEAN AIR, AND COASTAL PROTECTION
BOND ACT OF 2000 (FOR INSTALLATION OF A SKATEPARK AT
MCINNIS PARK)
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as
follows:
WHEREAS, the people of the State of California have enacted the Safe
Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection
Bond Act of 2000 which provides funds for the Roberti-Z'Berg-Harris
open Space and Recreation Program; and
WHEREAS, the Legislature of the State of California has enacted the
Roberti-Z'Berg-Harris Open Space and Recreation Program, which
provides funds to certain political subdivisions of the State of California
for acquiring lands and for developing facilities to meet urban
recreational needs; and
WHEREAS, the California Department of Parks and Recreation has been
delegated the responsibility for the administration of the grant program,
setting up necessary procedures; and
WHEREAS, said procedures established by the California Department of
parks and Recreation require the Applicant's Governing Body to certify
by resolution the approval of the Application before submission of said
application to the State; and
WHEREAS, the City of San Rafael, County of Marin, and Marinwood
Community Services District have entered into a Memorandum of
Understanding for a collaborative effort to plan and secure funds for the
installation of a skatepark at McInnis Park; and
WHEREAS, the applicant will enter into a Contract with the State of
California for the project:
NOW THEREFORE BE IT RESOLVED that the City Council hereby:

1. Approves the filing of an Application for local assistance funds from
the Roberti-Z'Berg-Harris Urban Open Space and Recreation
Program under the Safe Neighborhood Parks, Clean water, Clean
Air, and Coastal Protection Bond Act of 2000; and
2. Certifies the Applicant has or will have sufficient funds to operate and
maintain the Project; and
3. Certifies that the Applicant has reviewed, understands and agrees to
the General Provisions contained in the contract shown in the
Procedural Guide; and
4. Appoints the Director of Community Services as agent to conduct all
negotiations, execute and submit all documents including, but not
limited to Applications, agreements, payment requests and so on,
which may be necessary for the completion of the Project.

A RESOLUTION APPROVING MEMORANDUM OF UNDERSTANDING
BETWEEN THE COUNTY OF MARIN, MARINWOOD COMMUNITY
SERVICES DISTRICT AND THE CITY OF SAN RAFAEL FOR A
COLLABORATIVE EFFORT TO PLAN AND SECURE FUNDS FOR THE
INSTALLATION OF A SKATEPARK AT MCINNIS PARK
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as
follows:
WHEREAS, The County of Marin, Marinwood Community Services
District and City of San Rafael recognize the need for a skatepark facility
within their respective areas of influence; and
WHEREAS, The County of Marin has master planned a skatepark facility
in McInnis Park; and
WHEREAS, The County of Marin, Marinwood Community Services
District and City of San Rafael wish to coordinate planning efforts,
community input and grant funding for the installation of a skatepark
facility in McInnis Park;
NOW, THEREFORE, BE IT RESOLVED The City Council Approves The
Memorandum of Understanding between the County of Marin, the
Marinwood Community Services District and the City of San Rafael for a
Collaborative Effort to Plan and Secure Funds for the Installation of a
Skateboard Park at McInnis Park to wit:

MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF MARIN,
MARINWOOD COMMUNITY SERVICES DISTRICT AND THE CITY OF SAN RAFAEL FOR A
COLLABORATIVE EFFORT TO PLAN AND SECURE FUNDS FOR THE INSTALLATION OF
A SKATEPARK AT MCINNIS PARK
THIS MEMORANDUM OF UNDERSTANDING, dated February 20, 2001, is by and between the
County of Marin, a political subdivision of the State of California, (hereafter "COUNTY"), the Marinwood
Community Services District, a special district (hereafter "DISTRICT") and the City of San Rafael
(hereafter "CITY").
Article I. Background and Objectives
This Memorandum of Understanding outlines the responsibilities of COUNTY, DISTRICT AND CITY
as they relate to the preparation of planning documents needed to produce plans for a skatepark complex at
McInnis Park in San Rafael. These planning documents are necessary in order to have a detailed
conceptual plan and cost estimate for the purpose of preparation and submission of grant applications for
State Park Bond Act funding and other potential funding sources for the installation of the skatepark
facility. Funding requests will be a collaborative effort between the COUNTY, DISTRICT AND CITY.
It is a desire of the COUNTY, DISTRICT AND CITY to build skatepark facilities in their jurisdictions.
The lack of suitable sites for such facilities has deterred progress thus far. The COUNTY, DISTRICT,
AND CITY have determined that McInnis Park is the best site to locate a skatepark facility that will serve
the constituents of all three agencies. It has also been determined that a collaborative effort will increase
the opportunities for successful fund raising through grants and other resources, for the development of the
facility.
Article II. Statement of Understandings
1. COUNTY agrees to provide land at McInnis Park for the future site of a skatepark.
2. COUNTY, DISTRICT and CITY agree that designing the site and park, including cost estimates, is the
essential first step in developing the park. It is also agreed that community involvement, especially
youth involvement, is a necessary step in designing the park.
3. COUNTY agrees to hire a landscape architect, for the sum of $20,000, to act as project coordinator
and be responsible for the design of infrastructures and landscaping that will support the site.
4. COUNTY agrees to pay for surveying and civil engineering work up to a maximum of $10,000.
5. CITY agrees to contract with a skatepark architect, up to a maximum of $20,700. The architect must
specialize in skatepark design and have experience in skatepark design and supervision of construction
of skateparks. COUNTY has final approval of the architect.
6. COUNTY will oversee all plans and design work related to the skatepark project. Final plans will
require the approval by all three agencies.
7. CITY will oversee all community meetings, including youth involvement, and public relations dealing
with the conceptual planning process of the skatepark.
8. COUNTY, DISTRICT AND CITY will work collaboratively in the preparation of grant applications,
the securing of donations and contributions, and other means to assist the financing of the construction
of the skatepark.
Article III. Amendment
This Memorandum of Understanding may be amended or modified only by written agreement of all parties.

Thank you for the very productive meeting you hosted the other day. I am
glad to see both the County and the City of San Rafael agree on what is most
important in the McInnis Skateboard Park project, which is to get this safe but
exciting park on the ground, available for use by the kids, as soon as possible.

I understand that you are now the lead agency applying for the state grant through the
Roberti Z'berg portion of Prop 12, and that the Resolution your Council has to sign
certifies that the applicant has or will have sufficient funds to operate and maintain the
Slcatepark Project.
May this letter serve as commitment of the County of Marin to accept all maintenance of
the skateboard park as part of our McInnis Park. Our current staffing levels and other
resources are sufficient to handle these maintenance duties. (I believe it is agreed between
your Parks staff and ours that the skateboard park itself will not have on-site staffing).
McInnis Park is one of our most financially secure parks that we operate as we receive
significant revenues from field use and fees paid by the McInnis Park Golf Center.
I hope this letter serves in giving you assurance that there will be sufficient funds to
operate and maintain the Project. Dennis and I look forward to working with you and
Carlene to see this through.
