RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING STAFF TO PROCEED WITH THE PROCESS FOR ADOPTION OF
A THIRD AMENDED AND RESTATED CENTRAL SAN RAFAEL
REDEVELOPMENT PLAN AND DIRECTING ACTIONS RELATED TO THE
ADOPTION PROCESS
WHEREAS, the City Council of the City of San Rafael adopted the Central San Rafael
Redevelopment Plan by Ordinance No. 1079, adopted on November 20, 1972, as amended by
Ordinance No. 1572, adopted on October 16, 1989, as further amended by Ordinance No. 1669,
adopted on November 21, 1994, and as further amended by Ordinance No. 1732 on October 5,
1998 (collectively, the "Redevelopment Plan"); and
WHEREAS, during the course of Redevelopment Plan implementation by the San Rafael
Redevelopment Agency (the "Agency"), it has become apparent that in order to effectively
redevelop the existing Central San Rafael Redevelopment Project Area (the "Project Area"),
certain technical amendments to the Redevelopment Plan are necessary and appropriate to extend
the deadline to incur indebtedness to the maximum extent permitted by state law, to extend, as
permitted by state law, the date to commence eminent domain actions, to increase the limit of tax
increment revenue the Agency can receive under the Redevelopment Plan, and to conform the
powers of the Agency to current state law; and
WHEREAS, the proposed Amended Plan shall not add territory to the Project Area, nor
grant new authority to the Agency to acquire by eminent domain property on which a substantial
number of low and moderate income persons reside; and
WHEREAS, based on the foregoing, a Project Area Committee ("PAC") pursuant to
Health & Safety Code Section 33385.3 will not be formed in connection with the proposed
Amended Plan; and
WHEREAS, while a PAC will not be formed, the City Council desires to continue to
seek active consultation with the Citizens Advisory Committee (the "CAC"), interested residents,
business owners and community organizations in the Project Area concerning the preparation,
adoption and implementation of the proposed Amended Plan.
NOW, THEREFORE., BE IT RESOLVED, that the City Manager of the City of San
Rafael or the City Manager's designee is hereby authorized to consult with and obtain the advice
of the CAC, residents, business owners, and community organizations within the Project Area in
the manner provided in Health & Safety Code Section 33385 not requiring formation of a
statutory PAC.
