RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ACCEPTING ALBERT PARK LANE AS A PUBLIC STREET
WHEREAS, in 1937, Jacob Albert and Annie Albert gifted to the City a large
tract of land east of B Street then known as "Dufficy Field" for use as Park, playground and
public recreation; and
WHEREAS, Albert Park, consisting of the Albert Park baseball field,
playground and the tennis courts, was constructed in 1949 and the improvement plans also
included a 24' wide lane now known as Albert Park Lane; and
WHEREAS, in the 1970's, the City had purchased adjoining lands from several
private property owners, and the combination of all these properties is now known as Albert Park
Field; and
WHEREAS, although Albert Park Lane is not officially a public street, it has
been used by the public as a thoroughfare from B Street to Lindaro Street and for egress and
ingress to the Albert Park field and recreation facilities; and
WHEREAS, Parkside Childcare Center is presently being constructed on Albert
Park Lane, and in order for utilities to be installed under a franchise, the street needs to be
dedicated as a Public Street, and
WHEREAS, the City Council, at its Council's meeting on February 5, 2001,
approved the funding for street improvements; and
WHEREAS, the public interest, convenience, necessity and welfare require that
the real property hereinafter mentioned be accepted and used for the benefit of the public of the
City of San Rafael, California;
WHEREAS, the City Council finds that the acceptance of Albert Park Lane as a
public street is exempt from the requirements of the California Environmental Quality Act under
Section 15061(b)(3) of the CEQA Guidelines, which exempts projects that clearly will have no
significant adverse environmental impacts;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
San Rafael, California, does hereby under this Resolution dedicate Albert Park Lane as a public
street, and the Director of Public Works of the said City is hereby directed to cause a Record of
Survey, delineating the Albert Park Lane Right of Way, to be prepared and duly recorded in the
Office of the County Recorder of the County of Marin, State of California, forthwith upon the
adoption of this resolution.

certify that the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of the said City held on the 5th. day of March, 2001, by the following
vote, to wit:
