HomeMy WebLinkAboutLib Target Contribution to Library FoundationSAN RAFAEL Agenda Item No: THE CITY WITH A MISSION Meeting Date: November 7, 2016 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: LIBRARY Prepared by: SARAH HOUGHTON, LIBRARY City Manager Approval: DIRECTOR TOPIC: ACKNOWLEDGE FULFILLMENT OF TARGET CORPORATION'S COMMITMENT TO DONATE $250,000 TO THE SAN RAFAEL PUBLIC LIBRARY FOUNDATION SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ACKNOWLEDGING FULFILLMENT OF TARGET CORPORATION'S COMMITMENT TO DONATE $250,000 TO THE SAN RAFAEL PUBLIC LIBRARY FOUNDATION RECOMMENDATION: Staff recommends that the City Council adopt the attached Resolution acknowledging fulfillment of Target Corporation's Commitment to donate $250,000 to the San Rafael Public Library Foundation. BACKGROUND: In 2012, in conjunction with the plans to build the Target store on Shoreline Parkway in San Rafael, Target Corporation and Shoreline landowner Cal -Pox Inc. agreed to designate $250,000 in an escrow fund to be donated in $25,000 increments every year for ten years to the San Rafael Public Library Foundation for the purposes of building new and improved library facilities in San Rafael. This condition was written into the use permit Target obtained from the City of San Rafael. This use permit was addressed in Condition No. 10 of Resolution No. 13143 and Section 5 of Resolution No. 13141, each of which were adopted by the San Rafael City Council in connection with the development of the Target property. The first four years ($100,000) of donations were received by the San Rafael Public Library Foundation. This year, Target opted to close out this obligation with one final lump sum payment of $150,000 to the San Rafael Public Library Foundation, and receipt thereof has been acknowledged by the Foundation. ANALYSIS: The receipt of the agreed upon total of $250,000 by the San Rafael Public Library Foundation fulfills Target Corporation's obligations and commitment pursuant to Condition No. 10 of Resolution No. 13143 and Section 5 of Resolution No. 13141, each of which were adopted by the San Rafael City Council in connection with the development of the Target property. COMMUNITY OUTREACH: No community outreach has been conducted on this matter. FISCAL IMPACT: There is no fiscal impact to the City by adopting this resolution. OPTIONS: The City Council has the following options to consider on this matter: 1. Approve the Resolution. 2. Modify the Resolution. 3. Do not approve the Resolution RECOMMENDED ACTION: Approve the Resolution of the City Council of the City of San Rafael acknowledging fulfillment of Target Corporation's Commitment to donate $250,000 to the San Rafael Public Library Foundation. RESOLUTION NO. 14230 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ACKNOWLEDGING FULFILLMENT OF TARGET CORPORATION'S COMMITMENT TO DONATE $250,000 TO THE SAN RAFAEL PUBLIC LIBRARY FOUNDATION WHEREAS, in 2012, in conjunction with the plans to build the Target store on Shoreline Parkway in San Rafael, Target Corporation and Shoreline landowner Cal -Pox Inc. agreed to designate $250,000 in an escrow fund to be donated in $25,000 increments every year for ten years to the San Rafael Public Library Foundation for the purposes of building new and improved library facilities in San Rafael; and WHEREAS, the first four years ($100,000) of donations were received by the San Rafael Publ i c Library Foundation; and WHEREAS, Target Corporation has opted to close out this obligation with one final lump sum payment of $150,000 to the San Rafael Public Library Foundation; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Upon receipt by the San Rafael Public Library Foundation of the proposed lump sum payment of $150,000 from Target Corporation, the obligations of Target Corporation pursuant to Condition No. 10 of Resolution No. 13143 and Section 5 of Resolution No. 13141, each of which were adopted by the San Rafael City Council in connection with the development of the Target property, will be satisfied in full.
