A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL DETERMINING THAT THE CURRENT
PARAMEDIC TAX RATE FOR RESIDENTIAL AND NON-
RESIDENTIAL PROPERTIES IN THE CITY OF SAN
RAFAEL SHALL NOT BE REVISED AND SHALL BE
ASSESSED FOR FISCAL YEAR 1999/2000 AS PROVIDED IN
ORDINANCE NO. 1727; AND FURTHER CONFIRMING
THE PARAMEDIC TAX RATES THAT NEED TO BE SET
BY THE MARINWOOD SERVICES DISTRICT, COUNTY
SERVICES AREA NO. 13, AND COUNTY SERVICES AREA
NO. 19, IN ORDER TO PAY THE CITY'S COSTS IN
PROVIDING SUCH PARAMEDIC SERVICES.
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES AS FOLLOWS:
WHEREAS, the electors of the City of San Rafael in 1979 and 1988, adopted a paramedic
service tax (Chapter 3.28 of the San Rafael Municipal Code) to be imposed annually upon all
residential and commercial properties within the City of San Rafael; and
WHEREAS, the City Council last year, pursuant to its authority under the Paramedic Tax
Ordinance, and based upon a budget recommendation by the City Manager, adopted Ordinance No.
1727, setting the Paramedic Tax Rate commencing in fiscal year 1998/1999, at the basic residential
tax rate of $40.00 per living unit, and at a tax rate of $0.5 per square foot on non-residential
properties; and
WHEREAS, the passage of Proposition 218 by the voters of the State of California in
November of 1996 and the subsequent approval of SB919 by the State Legislature limited the
ability and scope under which the City Council has the authority to revise the amount of this tax;
and

WHEREAS, the electors of the City of San Rafael at an election held in November 1998,
failed to approve by the requisite 2/3 vote an increase in the maximum rates previously authorized
by the electors for such paramedic services; and
WHEREAS, San Rafael Municipal Code Section 3.28.060, requires the City Council to
determine annually, based upon a budget recommended by the City Manager, whether the
Paramedic Tax Rate shall be revised; and
WHEREAS, the City Council, after reviewing the proposed budget recommendation of the
City Manager, has determined that the City's existing Paramedic Tax Rates set by Ordinance No.
1727 for residential and non-residential properties in San Rafael should not be revised, since these
existing tax rates are the maximum rates currently permitted without further approval of the
electorate, and since these existing rates will partially, but not wholly, cover the cost of providing
paramedic services within the City, the remainder of such costs to be paid from other sources; and
WHEREAS, the City of San Rafael pursuant to existing joint powers agreements provides
paramedic services to Marinwood Community Services District, County Services Area No. 13, and
County Services Area No. 19; and
WHEREAS, foregoing Joint Powers Agreements require the City to determine the costs of
providing such paramedic services, and for the aforementioned public entities to pay for such costs;
and
WHEREAS, Marinwood Community Services District, County Services Area No. 13, and
County Services Area No. 19, pay the City for such paramedic services through a Paramedic
Service Tax approved by the electors in their respective jurisdictions; and

WHEREAS, the electors in Marinwood Community Services District, County Services
Area No. 13, and County Services Area No. 19, have approved in recent elections an increase in the
maximum rates for such Paramedic Services Tax; and
WHEREAS, on May 26, 1999, representatives of the City met with and provided
representatives of Marinwood Community Services District, County Services Area No. 13, and
County Services Area No. 19, with cost information indicating that the Paramedic Tax Rates within
each of the three public entities will need to be set for fiscal year 1999/2000 at $46.00 for each
living unit , and $.053 per square foot for each non-residential structure, in order to pay the City's
costs in providing such services; and
WHEREAS, the representatives from Marinwood Community Services District, County
Services Area No. 13, and County Services Area No. 19 agreed to pay the above -stated rates to City
to cover the cost of providing paramedic services to their jurisdictions, and the agreed-upon rates
are less than the maximum rates approved by the electors in their respective jurisdictions.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of San Rafael
as follows:
Section 1. The Paramedic Tax Rates for the City of San Rafael previously set by
Ordinance No. 1727 shall not be revised.
Section 2. The Assistant City Manager is directed to advise the County Auditor -
Controller that the Paramedic Tax Rates shall be assessed for fiscal year 1999-2000 as set forth in
Ordinance No. 1727, at the basic residential tax rate of $40.00 per living unit, and at a tax rate of
$.05 per square foot on non-residential properties.
Section 3. The City Council confirms that in order for the City to provide existing
paramedic services to Marinwood Community Services District, County Services Area No. 13, and

County Services Area No. 19, for fiscal year 1999/2000, each of these public entities will need to
set their tax rates and to pay City $46.00 for each living unit, and $.053 per square foot for each
non-residential structure.
Section 4. The Assistant City Manager is directed to provide a copy of this Resolution
to Marinwood Community Services District, County Services Area No. 13, and County Services
Area No. 19, and to notify the County Auditor -Controller.
The foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the San Rafael City Council held on the 19'h day of July, 1999, by the following vote to
wit:
