RESOLUTION AMENDING SECTION 3.0 OF RESOLUTION 10476 (ESTABLISHING
PRIORITY PROJECTS PROCEDURE) EXTENDING THE TIMELINE FOR CITY
STAFF REVIEW AND PROCESSING OF THE PRIORITY PROJECTS PROCEDURE
WHEREAS, on August 2, 1999, the San Rafael City Council adopted Resolution 10476,
which initiated the Priority Projects Procedure for 1999. The Priority Projects Procedure, which
is generally initiated annually by the City of San Rafael, implements San Rafael General Plan 2000
Program C -b (Project Approval Procedure for Traffic Impacted Areas). This program reads in
pertinent part as follows: "Develop a procedure for approving projects consistent with City
priorities where roadway capacity is limited, several projects are competing for capacity, and
needed improvements will take a significant time to construct"; and
WHEREAS, Resolution 10476 includes specific procedures and timelines for Priority
Project application filing and review by City staff. Specifically, Section 3.0 of Resolution 10476
established an application filing deadline of September 13, 1999. In addition, Section 3.0 requires
that within approximately 30 -days of the application filing deadline (or by October 13, 1999), City
staff is to complete an evaluation of all applications and prepare recommendations, staff reports
and public hearing notices; and
WHEREAS, on September 13, 1999, 10 Priority Project applications for the two traffic -
impacted areas were filed with the City. The applications involve large-scale development
proposals, as well as projects proposing various land use alternatives and phasing scenarios. The
number and complexity of the Priority Project applications requires additional time for City staff
review; and
WHEREAS, the additional time for staff review of these applications requires an
amendment to the timelines established by Section 3.0 of Resolution 10476; and
WHEREAS, it has been determined that a 30 -day extension to the timeline for review and
processing of the Priority Projects applications is necessary, reasonable and justified in that: a) the
additional time will ensure an adequate review of the numerous applications and b) none of the
development projects proposed in the Priority Projects applications would be significantly
impacted by the extension in the review timeline.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council does
hereby adopt an amendment to Section 3.0 of Resolution 10476 to read as follows
Section 3.0 Prioritv Proiect Determination Procedure
Within five business days following adoption of this resolution, the City Clerk shall cause to be
published in a newspaper of general circulation within the City and, shall mail to all those

requesting notification a Notice of Invitation to Submit Applications for Prioritv Proiect
Determination.
Following publication of the Notice of Invitation, all Applications for Priority Project
Determination shall be submitted. Within 40 days of notice publication, or by September 13,
1999, Applications for Priority Project Determination shall be submitted. The Notice of
Invitation shall specify the day, time and place for submittal of applications. No late application
shall be accepted. Only one Application for Priority Project Determination may be submitted per
separate legal building sites.
At the close of the application period as set forth in the Notice of Invitation, if there is a single
application for the Priority Projects Procedure designation in any circulation -impacted area and
(1) that application qualifies as a "high priority" project as defined by General Plan Policy C-7,
and (2) the merits of the proposed project in that application have previously been approved by
the City, then the Priority Projects Procedure designation for this single application shall be
deemed granted without further proceedings required by the City.
Within approximately 60 days following the application submittal deadline, or by November 15,,
1999, planning staff shall evaluate all applications timely submitted, prepare staff reports and
recommendations, and notice Planning Commission public hearing(s) concerning the same.
