RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING THE ANNEXATION AND PREZONING OF CERTAIN REAL
PROPERTY LOCATED AT 110 POINT SAN PEDRO ROAD.
WHEREAS, an application was submitted to the Planning Department
requesting annexation of the property at 110 Pt. San Pedro Road to the City of
San Rafael; and
WHEREAS, the application was filed by Boyd R. Lang, the owner of the
property; and
WHEREAS, the Local Agency Formation Commission by Resolution 98-
12, adopted September 8, 1998, made determinations and approved said
annexation of the 0.8 acre parcel; and
WHEREAS, On November 10, 1998, the Planning Commission
recommended that the City Council approve said request at a duly noticed
public hearing on the proposed Prezoning and Annexation applications,
accepting public testimony and considering all testimony and the written report
of the Planning Division staff; and
WHEREAS, the project qualifies as a Class 19 Categorical Exemption,
consistent with the requirements of the California Environmental Quality Act
(CEQA); and
WHEREAS, the area proposed to be prezoned is "uninhabited", by
definition established pursuant to the Cortese -Knox Act, and a description of the
property is set forth in Exhibit "A" attached hereto and incorporated herein by
reference.
NOW THEREFORE BE IT RESOLVED, that the San Rafael City Council hereby
approves the prezoning and annexation based on the following findings:
1. The proposed amendment to the R 20-C zoning district boundary map is
consistent with the General Plan land use designation of Low Density
Residential, the Zoning Ordinance and existing improvements.
2. The public health, safety and general welfare are served by the adoption of
the proposed amendment in that a) the prezoning is consistent with the existing
land use and general plan designation, b) the property is adjacent to existing
similarly zoned and developed parcels within the City limits, and c) the project
has been reviewed by the appropriate City agencies and it has been determined
that necessary public services and utilities are available and currently serve the
continued residential use of the parcel.
3. The property is found to be uninhabited as defined by the Cortese -Knox Act
and is adjacent to the City; municipal services can be provided effectively and
economically by the City given that the area is already improved to serve the
existing residential use; and the annexation is in conformance with the General
Plan annexation policies LU 3 through LU 7.
4. The annexation boundaries as described in Exhibit "A "legal description and
map attached, prepared by John Eric Brotschi, CE (County Assessor's Parcel 17-
181-36) shall be deemed approved upon the effective date of the zoning
ordinance amendment and the City Zoning and Bouridary Maps shall be revised
to reflect this change.

certify that the foregoing resolution was duly and regularly introduced and adopted at
a regular meeting of the City Council of said City held on the 7th day of

Beginnning at a point on the corporate city limits of San Rafael, said point.
also being the most northwesterly corner of Parcel One of 15 PM 68 as recorded
in the Office of the Recorder of Marin County, and on the southerly right of
way of Point San Pedro Road; thence from said Paint of Beginning along the
corporate city limits of San Rafael in a southeasterly and southwesterly
direction to the westerly line of APN #17-181-36 said line described in
Document 87-46337 filed in the Office of the Recorder of Marin County;
thence leaving said corporate city limits of San Rafael and along the westerly
line of Document 87-46337 North 25'43'00" West 220 feet more or less to the
southerly right of way line of Point San Pedro Road; thence along said
right of way North 63° 12'00" East 165.33 feet more or less to the
Point of Beginning.
Said parcel contains 0.8 acres more or less.
