A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ACCEPTING
THE REPORT OF THE AD HOC DINING ROOM COMMITTEE.
WHEREAS, On March 2, 1998, the City Council authorized formation and
implementation of the Ad Hoc Dining Room Committee (the "Committee") ; and
WHEREAS, the Committee was charged with reviewing and discussing the
specifics of a proposal to resolve issues relating to relocation of the St. Vincent de Paul
dining facilities and conditions of its operations; and
WHEREAS, the Committee met on the dates of May 7, May 21, June 4,
and June 30 to carry out the charge established by the City Council; and
WHEREAS, the Committee has prepared and filed a comprehensive report
of its meetings and work setting forth its recommendations to the City Council covering
the issues given to it.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL DOES HEREBY RESOLVE AS FOLLOWS:
Section 1 The City Council wishes to thank the community volunteers, Committee
members and especially Judge Eugene Lynch for their participation and dedication in
carrying out the charges given to the Committee by the City Council in March of 1998.

Section 2 The City Council concurs with the three major recommendations made in
the Committee's Report. Specifically,
a) The City Council agrees with the conditions to be adopted in connection with a
conditional use permit in connection with the relocation of the St. Vincent de Paul
Dining Room facility as more particularly set forth in Attachment A of the Ad Hoc
Dining Room Committee Report, attached hereto.
b) The City Council supports the concept of the formation of a Neighborhood Advisory
Committee and urges implementation of said Committee by St. Vincent de Paul, as
outlined in Attachment A. Pending permanent relocation of the St. Vincent de Paul
Dining Room facility, the City Council accepts and supports immediate implementation
of the St. Vincent de Paul Community Advisory and Outreach Program, more
particularly set forth in Attachment C.
c) The City Council accepts the recommendation for the relocation site as set forth in
Attachment B of the Ad Hoc Dining Room Committee Report attached hereto.
Section 3 The City Council urges St. Vincent de Paul to begin the application, design
review, use permit and site relocation processes in an expedient manner in order to carry
out the Ad Hoc Dining Room Committee's recommendations.
Section 4 The City Council directs the Redevelopment Agency staff to begin the site
disposal and relocation processes for the "B" Street redevelopment project in an
expeditious manner in order to carry out the Ad Hoc Dining Room Committee's site
recommendations.
Section 5 This Resolution shall become effective immediately upon its adoption.
Section 6 The City Clerk shall certify the adoption of this Resolution.

SUBJECT: St. Vincent de Paul Proposed Conditional Use Permit
We are please to advise you that the City and SVDP have achieved conceptual
agreement on the following proposed conditions for a use permit regulating the
facility under discussion Further discussions may take place once an actual site has
been selected.
1. Definition of Operations
a. SVDP is a social service agency whose primary mission is to feed the
hungry and provide a place for their social interaction at its dining room.
b. In addition, SVDP prepares and distributes meals to churches and
other social service agencies in the area, such as Homeward Bound, Ritter House,
Marin People Care and CareMax.
c In addition. SVDP hosts programs, classes, counseling, health
screening and spiritual services at the dining room by such organizations as Marin
County Legal Aid, Interfaith Homeless Chaplaincy, Alcoholics Anonymous, County
Health Services. Mann Treatment Center and Veterans' Administration.
d The administrative offices above the dining room are the central
coordinating location for other services provided by the Society.
e. SVDP also provides food service training.
SVDP has historically provided low income housing.
2. Hours of Operation
Food service occurs between 8.30 a.m and 1:00 p.m daily, and food preparation
occurs from 9.30 a m to 6:00 p.m. Educational and social services occur after noon
Evening use includes meetings and periodic special events

3. Drugs, Alcohol and Other Controlled Substances
SVDP will maintain and enforce a policy that drugs, alcohol and other controlled
substances will not be permitted on its property. Violation of this policy will lead to
denial of services to violators.
4. Code of Conduct
SVDP shall provide a copy of their Code of Conduct to be explained to all new
clients of the facility, as part of its new client orientations. SVDP will create a
checklist to ensure that one element of each orientation will be to present the new
client with a copy and explanation of the Code of Conduct. In addition, the Code of
Conduct shall be posted in conspicuous locations in the dining room The Code of
conduct shall, at a minimum, include the following:
a. No diners will be admitted, who in the judgment of the SVDP staff, are
under the influence of alcohol or other substances.
b. Violent or threatening behavior will not be permitted and will constitute
reason for eviction of clients. Clients who cause a peace disturbance or endar;.zr
staff or other clients shall be evicted.
C. Loitering in the vicinity of the SVDP premises shall be prohibited.
d. Failure to comply with the Code of Conduct may result in eviction from
the facility and denial of food service.
e. The Code of Conduct should be approved by the San Rafael Chief of
Police prior to occupancy of the new facility
The Code of Conduct shall be posted in conspicuous locations in the
dining room.
g. SVDP will take all reasonable measures withal its means to
consistently enforce the Code of Conduct.
h. SVDP will append its Code of Conduct to the CUP
5. Security Program
SVDP shall create and maintain a security program during all operating hours of the
dining room. The security program shall be approved as to content by the San
Rafael Chief of Police prior to occupancy of the new dining room
6. Litter Program
SVDP shall maintain a litter program, to monitor and pick up litter within 200 feet of
the facility, a minimum of three times per week. The program shall be submitted for

approval to the Community Development Director prior to occupancy of the new
facility.
7. Compliance with Applicable Regulation and Codes
SVDP shall comply with all applicable Uniform Building Code, Fire Code and County
health regulations in connection with operation of its facility.
8. Storage of Donated Materials
SVDP shall store all donated materials inside their facility buildings, so as not to be
visible. No storage will be allowed in any parking area on the site. SVDP will comply
with the San Rafael Zoning Ordinance and the Uniform Building Code and all other
city codes and development policies in connection with the erection of any additional
storage buildings to be located on the site.
9. Community Relations
SVDP and the City shall jointly appoint a Neighborhood Advisory Committee to
advise on SVDP dining room operations, including issues related to the CUP and
calls for police service, and to constructively resolve issues or conflicts that might
arise as a result of SVDP operations.
a. The Neighborhood Advisory Committee shall be comprised of five
representatives selected from the business community, neighborhood associations,
social service providers and the faith community and four members of the Board of
the dining room. The Chamber of Commerce, Business Improvement District,
Federation of San Rafael Neighborhoods. Continuum of Housing and Social
Services and Interfaith Council shall be asked to nominate representatives to serve
on the Neighborhood Advisory Committee.
b. The Neighborhood Advisory Committee shall establish an outreach
program with the surrounding neighbors in order to provide a forum to consider and
act upon suggestions, questions, complaints and comments from the community.
C. SVDP will designate a contact person for the receipt of comments and
complaints The name of the contact person during all hours of operation shall be
provided to city staff and shall be posted in a conspicuous place on the premises.
The contact person shall serve as a liaison to the community and city staff and may,
at times, meet with concerned citizens off -premises.
d. As set forth in Section 11 below, the Neighborhood Advisory
Committee shall be charged with the initial responsibility of resolving any issues,
problems or complaints received concerning SVDP operations at the facility. The
Ne+ghborhood Advisory Committee shall establish a process for resolving complaints
and monitoring compliance with the conditional use permit.

10. Off -Premises Consumption of Food
SVDP's free meal program will not provide any containers for consumption of food
off -premises. However, SVDP will continue to serve the elderly, families and guests
who visit with their own containers and eat their meals at home, as well as other
agencies to whom the dining room delivers food, including the Ritter House. SVDP
will not serve food to violators of the Code of Conduct outside of the premises.
11. Procedure for Informal Resolution of Problems Prior to Commencement
of Public Hearings
Prior to the commencement of any formal proceeding regarding any alleged violation
of the CUP and only after the Neighborhood Committee has been unsuccessful in
resolving any complaint prior to the time it is formally submitted to the City. the
following procedure shall be followed:
a. Written notice and cure penod. In the :vent the City claims that
SVDP's action (or inaction) constitutes a violation or breach of the CUP, the City
shall provide written notice of default to SVDP and the Neighborhood Advisory
Committee, which shall be given 45 days from the date of the Notice of Default to
cure the alleged violation and resolve any dispute related to the alleged violation (the
"cure period").
b. In the event that the alleged violation or dispute is not cured and the
dispute is not resolved after the steps required pursuant to subparagraph a. have
been taken, the City may initiate a formal review pursuant to its Municipal Code that
it deems appropriate.
12. There may be conditions to regulate parking, once the new site is known and
agreed upon.
13. SVDP agrees to an impartial audit of the number of clients who currently use
the SVDP facility on B Street by a mutually agreeable third party prior to occupancy
of the new facility. The audit will not be a condition of the CUP.
14. There may well be site specific conditions that must be discussed, once the
site is known.
15. Review of Operations
The Planning Commission will hold one hearing on SVDP's compliance with the CUP
six months after SVDP occupies the new facility. A report will be presented to the
Planning Commission by the Community Development Department and the Police
Department. Thereafter, the procedures outlined in the CUP shall govern how the
City addresses disputes regarding the CUP

After a careful search of potential sites in the Ritter Street area, San Rafael City staff and
representatives of the St. Vincent de Paul Society have identified what we believe is a workable
location for the non-profit agency's facility.
After researching and reviewing eight sites in the Ritter Street area, representatives from the
City and St. Vincent's have settled on a corner location on Lindaro Street between Second and
Third Streets. The site, in the range of approximately 16,000 square feet, is a portion of a
parking lot currently leased for parking use by downtown business owners.
Two advantages of the proposed dining room location are that it does not require relocating any
businesses or demolishing any buildings, and does not require utilization of condemnation
procedures. Every other site reviewed required business relocation, demolition of structures and
likely owner and tenant opposition.
In conjunction with the corner property for the St. Vincent de Paul facility, City and PG&E
officials have agreed to discuss the redevelopment of the entire three -acre block that currently
contains the PG&E customer service center and employee parking lot. Potential uses for the
entire three -acre block includes offices, hotel and mixed-use commercial.
The City feels that other nearby developments such as the Fair Isaac office complex, Kaiser
medical offices, Andersen Drive opening, new movie screens and a Walgreen's drugstore, have
enhanced developer interest in this key block.
City staff, St. Vincent's and PG&E view this location as the best possible solution available:
• St. Vincent's obtains a downtown location in the Ritter Street area, on which to build a new
and better facility to carry out its mission in harmony with the surrounding neighborhood.
• The City benefits from resolution of the issue of where St. Vincent's carries out its mission,
and assists in the redevelopment of a key downtown block. The location would also permit
the City to redevelop the downtown block bordered by B, A, Second and Third Streets.
• PG&E helps resolve a community issue and is able to dispose of an under-utilized asset.

ATTACHMENT C
St. Vincent de Paul Community Advisory and Outreach Program
This committee will assist in building a model program as well as responding to
community concerns.
1. St. Vincent's Community Advisory and Outreach Committee will include
representatives of neighborhood associations, the Business Improvement
District, the Chamber of Commerce, immediate neighbors, Dining Room
guests, faith -based organizations, the San Rafael School District and/ or PTA,
social service agencies, and community builders throughout San Rafael who
are interested in serving as advisory and outreach volunteers.
2. St. Vincent's will allow organizations to name their own members.
3. St. Vincent's will take the initiative to create and begin this committee
immediately.
Here is how we're going to do this:
We will listen to any concerns and suggestions, regarding St Vincent's operations,
to bring to focus groups and that emanate from focus groups.
For example, conflict resolution:
• We will set up a mechanism to involve our Board of Directors and business
and community advisors to:
• listen to the issue
• develop a plan and share it with the person who brought it to the Committee
If this is not adequate:
• We will re-engage with the individuals and bring in more resources to reach
resolution in all areas, eg. traffic, design, etc.
2. We will inform merchants, neighborhood associations, and school constituency of
SVDP contact person, Executive Director Sue Brown. Leave Sue's card for
everyone.
3. We will initiate community dialogue in an effort to problem solve: to elicit any
suggestions for ways in which the community can meet the needs of the poor and
homeless people, or work with substance addicted or mentally disabled and
substance addicted (dually diagnosed) people. Our surveys of immediate neighbors
indicate their desire to have homelessness issues addressed, differentiating between
these issues and Dining Room issues.
4. We are committed to inform the community: let the community know what's going
on at St Vincent's. A merchant on B St said,"it is a mistake to talk about'we' and
'them'; St.Vincent's vs. the merchants. We should all be working on this together.
We are all merchants, we are all neighbors."
5. For each of the programs I've outlined we will similarly be putting into place
mechanisms that include and involve community in creating a facility and
program that would become a model for faith -based providers nation-wide.
