A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL, CALIFORNIA, DECLARING THE RESULTS OF A PROPERTY
OWNER PROTEST PROCEEDING
The City Council of the City of San Rafael (hereafter referred to as the "City Council")
does resolve as follows:
WHEREAS, the City Council called and duly held a property owner protest
proceeding for the Point San Pedro Road Landscaping District (hereafter referred to as
the "District") pursuant to Resolution #10017 for the purpose of presenting to the qualified
property owners within the District a proposition for the levy and collection of
assessments for the costs and expenses of the landscape improvements within; and,
WHEREAS, the landowners of record within the District as of the close of the
Public Hearing held on April 6, 1998 did cast their ballots, the results of which are
attached as Exhibit "A".
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DOES HEREBY RESOLVE AS FOLLOWS:
Section 1 The above recitals are true and correct.
Section 2 The proceeding was conducted, with ballots presented to qualified property
owners of the District for receipt by the City Clerk on April 6, 1998, weighted according to
the proportional financial obligation of the affected property.
Section 3 The canvass of the votes cast in the District at the property owner protest
proceeding held in the District on April 6, 1998, is hereby approved and confirmed.
Section 4 The City Clerk is hereby directed to enter this Resolution on the minutes of the
City Council which shall constitute the official declaration of the result of such property
owner protest proceeding.
Section 5 This Resolution shall become effective immediately upon its adoption.
Section 6 The City Clerk shall certify the adoption of this Resolution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the
foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on the 6th day of April, 1998 by the following vote, to
wit:
AYES: COUNCILMEMBERS: COHEN, MILLER, PHILLIPS AND MAYOR BORO
NOES: COUNCILMEMBERS: NONE
ABSENT: COUNCILMEMBERS: HELLER
