A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL, CALIFORNIA, ABANDONING PROCEEDINGS FOR THE
FORMATION OF THE POINT SAN PEDRO ROAD LANDSCAPING
DISTRICT AND ASSOCIATED ASSESSMENTS
The City Council of the City of San Rafael, California (hereafter referred to as the "City
Council') does resolve as follows:
WHEREAS, the City Council has by previous Resolutions initiated proceedings,
declared its intention to levy assessments, approved the Final Formation and Levy
Report (hereafter referred to as the "Report") that describes the assessments against
parcels of land within the Point San Pedro Landscaping District (hereafter referred to
as "District") pursuant to the provisions of the Landscaping and Lighting Act of 1972,
Part 2 of Division 15 of the California Streets and Highways Code, commencing with
Section 22500 (hereafter referred to as the "Act") that provides for levy and collection
of assessments by the County of Marin for the City of San Rafael; and,
WHEREAS, the City conducted the property owner protest proceeding pursuant
to the provisions of the California Constitution, Articles XIIIC and XIIID; and,
WHEREAS, the results of the property owner balloting indicated a majority
protest against the assessment;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DOES HEREBY RESOLVE AS FOLLOWS:
1. Following notice duly given, the City Council has held a full and fair Public
Hearing regarding the District, the levy and collection of assessments, the
Report prepared in connection therewith, and considered all oral and written
statements, protests and communications made or filed by interested persons
regarding these matters.
2. The City Council hereby orders proceedings for the formation of the Point San
Pedro Road Landscaping District abandoned.
3. The City Council hereby orders proceedings for the adoption of assessments for
the Point San Pedro Road Landscaping District abandoned.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the
foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on the 6" day of April, 1998 by the following vote, to
wit:
AYES: COUNCILMEMBERS: COHEN, MILLER, PHILLIPS AND MAYOR KORO
NOES: COUNCILMEMBERS: NONE
ABSENT: COUNCILMEMBERS: HELLER
