A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING THE USE OF EAST SAN RAFAEL TRAFFIC MITIGATION FEES TO
FUND THE PLANNING, DESIGN, CONSTRUCTION AND ADMINISTRATION OF AN
INTERIM SOLUTION TO THE IRENE STREET OVERCROSSING WITH
ANCILLARY TRAFFIC IMPROVEMENTS AND AUTHORIZING STAFF TO
COMMENCE NEGOTIATIONS FOR ALL NECESSARY PROPERTY ACQUISITION
FOR THESE IMPROVEMENTS.
WHEREAS, the Circulation Element of the General Plan identifies area -
wide circulation improvement for the East San Rafael area and includes two (2)
alternatives for the Phase II Bellam Interchange improvement, one alternative which is
commonly know as the Irene Street Overcrossing; and
WHEREAS, the Circulation Element of the General Plan identifies
funding for the Irene Street Overcrossing to be one-third from the East San Rafael Traffic
Improvement Fee and two-thirds from regional program funds; and
WHEREAS, the regional program funds are not currently available to fund
the Irene Street Overcrossing; and
WHEREAS, on January 20, 1998, City Council held a public hearing to
review a traffic operational analysis of the Bellam Boulevard corridor and environs which
identified potential short-term and long-term solutions and recommended four (4) traffic
operation improvements and an interim solution to improve traffic flow and increase
capacity in the East San Rafael Area; and
WHEREAS, on January 20, 1998, the San Rafael City Council during the
duly noticed Public Hearing accepted public testimony and accepted the written report of
the Public Works Department staff which determined the interim solution and ancillary
traffic improvements will improve traffic flow, decrease congestion, increase capacity in
the East San Rafael Area and essentially function as a feasible alternative to the Irene
Street Overcrossing; and
WHEREAS, construction of the interim solution and ancillary traffic
improvements require acquisition of private property; and
WHEREAS, on January 20, 1998, the San Rafael City Council held a duly
noticed Public Hearing on the Negative Declaration for the project, accepted public
testimony, accepted the written report of the Public Works Department staff and certified a
Negative Declaration for the project to be in compliance with CEQA and adopted findings
that the project would not create significant environmental impacts;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF
THE CITY OF SAN RAFAEL AS FOLLOWS:
1. Funding for construction of the Irene Street Overcrossing is not available.
2. Public comments from the public workshops held by staff indicate that traffic
conditions are approaching unacceptable levels and that traffic improvements are
required.
3. Construction of the interim solution and ancillary improvements will reduce
congestion and increase capacity in the East San Rafael area and essentially function
as a feasible alternative to the Irene Street Overcrossing.
4. Construction of the interim solution and ancillary improvements are consistent with
the City of San Rafael General Plan.
5. It is appropriate to use East San Rafael Traffic Mitigation Fees to fund the planning,
design, construction and administration of the interim solution and ancillary
improvements.
6. Staff is authorized to commence negotiations on all necessary property acquisition to
construct the interim solution and ancillary improvements.

the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of
the Council of said City on the 20th day of January, 1998, by the following vote, to wit:
