DESCRIBING PROPOSED IMPROVEMENTS AND SERVICES AND
APPROVAL OF THE PRELIMINARY ENGINEER'S REPORT
REGARDING THE PROPOSED FORMATION OF POINT SAN PEDRO
ROAD LANDSCAPING DISTRICT AND ESTABLISHMENT OF
ASSESSMENTS FOR POINT SAN PEDRO ROAD LANDSCAPING
DISTRICT.
The City Council of the City of San Rafael, California (hereafter referred to as the "City
Council") does resolve as follows:
WHEREAS, the City Council pursuant to provisions of the Landscape and
Lighting Act of 1972 (Commencing with Section 22500) Part 2, Division 15 of the
California Streets and Highways Code (hereafter referred to as the "Act") did by
previous Resolution, initiate proceedings for the formation of Point San Pedro Road
Landscaping District (hereafter referred to as the "District"), pursuant to the provisions
of the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets and
Highways Code of California, beginning with Section 22500 (hereafter referred to as
the "Act"), and did order the preparation of a Preliminary Engineer's Formation and
Assessment Report (hereafter referred to as the "Engineer's Report") for said District,
and
WHEREAS, the City Council has retained MuniFinancial, Inc. (hereinafter
"Engineer"), for the purpose of assisting with the formation of the District and
establishment of the assessments, and to prepare and file an Engineer's Report with
the City Clerk in accordance with the Act; and in accordance with the requirements of
the California Constitution, Articles XIIIC and XIIID, and
WHEREAS, the Engineer has presented to the City Council the Preliminary
Engineer's Report, which Engineer's Report is attached hereto and incorported herein
by reference, and
WHEREAS, the City Council has carefully examined and reviewed the
Preliminary Engineer's Report as presented, and is satisfied with the District, each and
all of the budget items and documents as set forth therein, and is satisfied that the
assessments have been spread in accordance with the special benefits received from
the improvements, the debt service associated with the improvements, and the
operations, maintenance and services to be performed within the District, as set forth in
the Engineer's Report;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DOES HEREBY RESOLVE AS FOLLOWS:
1. The above recitals are true and correct.

2. That the Engineer's Report as presented, and consisting of the following:
a. A Description of improvements and services to be provided by the
District.
b. The Construction/Renovation Budget (for which bonds are
proposed to be issued).
C. The Annual Budget (estimates of costs and expenses of services,
operations and maintenance),
d. The Method of Assessment Apportionment,
e. The District Roll containing the Fiscal Year 1998/99 Levy for each
Assessor Parcel with the District, and
f. A Diagram for the boundaries of the District and all zones within
the District,
is hereby approved pursuant to Sections 22586, 22606 and 22623 of the Act, and
ordered to be filed in the Office of the City Clerk as a permanent record and to remain
open to public inspection.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the
foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on the 2"d day of February 1998, by the following
vote, to wit:
