HomeMy WebLinkAboutCC Resolution 9929 (Shamrock Center)RESOLUTION 9 9 2 9 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING THE MASTER USE PERMIT (UP97-1), AND ENVIRONMENTAL AND DESIGN REVIEW PERMIT (ED97-3) FOR THE DEVELOPMENT OF A 48,350 SQ. FT. RETAIL BUILDING AND A 12,050 SQ. FT. AUTOMOBILE DEALERSHIP KNOWN AS THE SHAMROCK CENTER; 655 Irwin Street; (APN 13-032-01, 02, 04, 05, 06 and a portion of 13-021-38) WHEREAS, on September 5, 1997, applications requesting a Master Use Permit and an Environmental and Design Review Permit for the above referenced project were found by the Planning Department to be complete for processing; and, WHEREAS, on September 25, 1997 the San Rafael Planning Commission held a duly noticed Public Hearing on the proposed Use Permit and Design Review Permit applications, accepting public testimony and the written report of the Planning Department staff and recommended approval of the project to the City Council; and, WHEREAS, on October 6, 1997 the San Rafael City Council held a duly noticed Public Hearing on the proposed Use Permit and Environmental and Design Review Permit applications, accepting public testimony and the written report of the Planning Department; and, WHEREAS, the City Council reviewed and considered the proposed environmental document, public testimony and staff reports and has adopted by separate resolution the Mitigated Negative Declaration, including the Mitigation Monitoring Program for the project; and, WHEREAS, the City Council reviewed and considered public testimony and the staff reports on the Zone Change and has passed an Ordinance to print designating the site as Planned District for retail and automobile sales and services uses; and ��� L C�' WHEREAS, the City Council determined that the proposed use is in accord with the General Plan, the objectives of the Zoning Ordinance, and the purpose of the district in which it is located because the project, as conditioned, is consistent with the goals and policies of the General Plan 2000 including Policies: Land Use Policies LU -14.d., Intensity of Commercial and Industrial Development, LU -19, Design Approach, LU -21, Building Height, LU -24, Entryways to the City, LU -30, Street Tree Planting, LU -35, Project Design Considerations, and LU -44, Lot Consolidation; Circulation Policies C-1, Level of Service, and C-18, Area Transportation Improvement Program; Natural Environment Policy NE -17, Creek/Drainageway Setback; Safety Policies S-4, Geotechnical Review, S-7, Potentially Hazardous Soils Conditions, S-21, Fire Safety of New Development, and S-23, Safety Review of Development Projects; Francisco Blvd. West Policies FBW-2, Specialty Retail Uses, FBW-8, Unused Portions of the NWP Right -of - Way, FBW-10, Highway 101 Frontage Area Design, FBW-14, Relationship with Bret Harte Neighborhood, and FBW-25, San Rafael Creek; and, WHEREAS, the City Council determined that the proposed use together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity, or to the general welfare of the City because the site is in an urban area and is being redeveloped from a previous industrial use to commercial uses consistent with the surrounding area; and, WHEREAS, the City Council determined that the proposed use complies with each applicable provision of the Zoning Ordinance including Sections: 14.02.020J, Multiple Applications; 14.07.030, Property Development Regulations; 14.16.080, Creeks and Other Watercourses; 14.16.150, Floor Area Ratios Applicable to Nonresidential Development; 14.16.170, Geotechnical Review; 14.16.180, Hazardous Soils Conditions; 14.18.040, Parking Requirements; 14.18.050, Off -Street Loading and Unloading; 14.18.160, Parking Lot Screening and Landscaping; 14.18.170, Lighting; and, 14.25.050, Review Criteria; and, -2- WHEREAS, the City Council determined that the project is designed in accord with the General Plan and the objectives of the Zoning Ordinance including the Review Criteria for Design Review Permits contained in Section 14.25.050 of the Zoning Ordinance; and, WHEREAS, the City Council determined that the project design is consistent with all applicable site, architecture, and landscaping design criteria and guidelines for the district in which the site is located because the project has been reviewed by the Design Review Board who stated that the buildings were well designed and articulated. The project is meeting the required parking, landscaping and setbacks and has incorporated the design criteria contained in Section 14.25.050, Review Criteria, of zoning ordinance in the project; and, WHEREAS, the City Council determined that the project design minimizes adverse environmental impacts because the project has been reviewed by the Design Review Board who stated that the buildings were well designed and articulated. The project is meeting the required parking, landscaping and setbacks and has incorporated the design criteria contained in Section 14.25.050, Review Criteria, of zoning ordinance in the project; and, WHEREAS, the City Council determined that the project design will not be detrimental to the public health, safety or welfare, nor materially injurious to properties or improvements in the vicinity because the project has been reviewed by the appropriate agencies and has been modified through design changes or conditions of approval. NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council finds there is no substantial evidence in the record showing that the project could have a significant detrimental impact upon the neighborhood and approves the Master Use Permit and Environmental and Design Review Permit for the Shamrock Center located at 655 Irwin Avenue.
