RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
ADOPTING GENERAL PLAN AMENDMENT TO CHANGE
THE LAND USE DESIGNATION ON A PORTION OF LOT 21
OF THE MONTEVIDEO TERRACE SUBDIVISION FROM
PUBLIC/QUASI-PUBLIC TO LOW DENSITY RESIDENTIAL
(APN 165-230-22)
(GPA96-3)
WHEREAS, on December 19, 1996, an application for a General Plan Amendment to change
the Land Use Designation from Public/Quasi-Public to Low Density Residential was found by
the Planning Department to be complete for processing; and,
WHEREAS, upon review of the subject application a Mitigated Negative Declaration was
prepared consistent with the requirements of the California Environmental Quality Act (CEQA);
and,
WHEREAS, notification of the proposed GPA96-3 amendment occurred as specified by law;
and,
WHEREAS, staff identified the amendments, with corresponding background analysis in the
June 10, 1997 Report to Planning Commission; and,
WHEREAS, the San Rafael Planning Commission is required by state law to hold at least one
public hearing and make a written recommendation to the legislative body on the adoption of any
General Plan Amendments; and,
WHEREAS, the Planning Commission held a public hearing on June 10, 1997, to hear public
comments on the proposed amendments; and,
WHEREAS, the Planning Commission adopted a resolution recommending approval of the
proposed General Plan Amendments (GPA96-3) on June 10, 1997; and,
WHEREAS, the City Council held a public hearing on the General Plan Amendments on July 7,
1997; and,

WHEREAS, the City Council has adopted by separate resolution the Mitigated Negative
Declaration, including the Mitigation Monitoring Program, for the project, and
WHEREAS, the City Council considered all verbal and written testimony on the General Plan
Amendments; and,
WHEREAS, the City Council determined that the public interest is served by the adoption of the
proposed General Plan amendment because the amendment is not in conflict with other General
Plan Policies and it will permit four new single family residences which match the recently
constructed homes on Montevideo Terrace and will also permit the existing non-profit uses
which provide needed services to the community to remain at the site.
NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council adopts the
General Plan Amendment changing the land use designation from Public/Quasi-Public to Low
Density Residential on a portion of Lot 21 of the Montevideo Terrace Subdivision located at 70
Skyview Terrace (APN 165-230-22) as shown on the attached map, Exhibit A:
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing
resolution was duly and regularly introduced and adopted at a regular meeting of the City
Council of said City held on Mondav the 7`h day of -July_, 1997 by the following vote, to wit:
