RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL, CALIFORNIA, INITIATING PROCEEDINGS FOR THE
FORMATION OF THE PT. SAN PEDRO MAINTENANCE
ASSESSMENT DISTRICT 97-3, AND THE LEVY AND
COLLECTION OF ASSESSMENTS FOR FISCAL YEAR 1998/991
PURSUANT TO THE PROVISIONS OF PART 2 OF DIVISION
15 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE
The City Council of the City of San Rafael (hereafter referred
to as 'City Council') Hereby Finds, Determines, Resolves and
Orders as Follows:
Section 1 Pursuant to the request of Neighborhood
Associations located along Pt San Pedro Road, the City Council
desires to initiate proceedings for the formation of the Pt.
San Pedro Maintenance Assessment District 97-3 (hereafter
referred to as the "District") within the territory described
in Section 2 of this Resolution, pursuant to provisions of the
Landscape and Lighting Act of 1972, Part 2, Division 15 of the
California Streets and Highways Code (commencing with section
22500) (hereafter referred to as the "Act"), pursuant to
Article 1 of Chapter 2 of the Act; that provides for the
formation of an assessment district to pay the cost and
expenses of the improvements described in Section 3, hereof.
Section 2 The territory proposed to be included within
the District boundary is generally described as follows:
The territory of the proposed District is within the
boundaries of the County of Marin and City of San Rafael,
located within the County of Marin, State of California and
includes approximately 2,857 parcels totaling approximately
2,431 acres. The territory of the proposed District
includes residential subdivisions and commercial properties
along or near Pt. San Pedro Road between Union Street and
Biscayne Drive and lies generally within the assessment
district boundary map attached to this resolution.
Section 3 The proposed improvements for the District
are briefly described as the installation, operation,
maintenance and servicing of landscape improvements along Pt.
San Pedro Road.
The specific areas of improvement includes all landscape
amenities along the Pt. San Pedro Road Median.
The improvements include all necessary service, operations,
administration and maintenance required to keep the
improvements in a healthy, vigorous, and satisfactory
condition and may include but are not limited to:
landscaping within the public right-of-ways including the
installation, cultivation, replacement and maintenance of
planting material such as turf, ground cover, shrubs, and
trees; maintenance and repair of landscape irrigation and
drainage systems and other appurtenant facilities permitted
under the Act.
Section 4 The City Council hereby orders the Engineer,
MuniFinancial, to prepare and file with the City Clerk a
report in writing in connection with the formation of the
District for the fiscal year commencing July 1, 1998 and
ending June 30, 1999. The report shall be prepared in
accordance with Article 4 of Chapter 1 of the Act.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the
Council of said City on the 4th day of August, 1997, by the
following vote, to wit:
