RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING THE
ENVIRONMENTAL AND DESIGN REVIEW PERMIT FOR A 6,583 SQUARE
FOOT LIGHT INDUSTRIAL/OFFICE BUILDING

WHEREAS, the proposed project consists of an Environmental and Design
Review application to permit a 6,583 square foot light industrial/ office
building; and,
WHEREAS, upon review of the subject applications an environmental
Initial Study was prepared consistent with the requirements of the California
Environmental Quality Act (CEQA); and,
WHEREAS, on October 24, 1995, the San Rafael Planning Commission held a
duly noticed Public Hearing on the proposed Negative Declaration and
Environmental and Design Review Permit, accepting public testimony and
the written report of the Planning Department staff; and,
WHEREAS, on October 24, 1995, the San Rafael Planning Commission voted
to recommend adoption of the Negative Declaration and approval of the
Environmental and Design Review permit; and,
WHEREAS, by separate resolution the City Council has adopted the Negative
Declaration; and,
WHEREAS, the City Council held a public hearing on the Environmental
and Design Review Permit on November 6, 1995; and,
WHEREAS, the Council considered all verbal and written testimony and
voted to approve the Environmental and Design Review Permit.
NOW THEREFORE BE IT RESOLVED, that the San Rafael City Council
hereby approves the Environmental and Design Review Permit subject to the
attached conditions based upon the following findings:

1. As modified by the conditions of approval, the proposal is consistent
with the criteria established for approving design review applications
with regard to overall design, materials and colors. Additionally, the
project has been designed to be compatible with the surrounding
neighborhood.
2. The proposed project is consistent with the General Plan Land Use
designation of Light Industrial/ Office and is allowed by right in the
LI/O zone. The proposal is for a 6,583 Light
Industrial/Warehouse/Office building.

3. The project will not be detrimental to the health, safety, or general
welfare of the surrounding neighborhood or the City of San Rafael as
the proposal is seen as appropriate in the neighborhood and compatible
with surrounding use.

foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Monday, the Sixth day of November, 1995, by

CONDITIONS OF APPROVAL:
Fire Devartment
(1) A fire department approved Knox keyway system is required to be installed
conforming to Fire Prevention Std. 202.
(2) Security gates, Electronic gates, or chains across driveways shall have installed
an approved Knox keyway system conforming to Fire Prevention Std. 205.
(3) Addresses shall be posted conforming to Fire Prevention Std. 205.
(4) Based on Uniform Building Code or Fire Code requirements, an automatic
fire sprinkler system shall be installed throughout conforming to NFPA Std.
13.
(5) The alarms from fire detection systems and commercial fire sprinkler systems
shall be monitored by a UL Central Station Company approved by the San
Rafael Fire Department and be issued a UL serially numbered Certificate for
Central Station Fire Alarms.
(6) A permit application shall be submitted to the Fire Prevention Bureau with
two sets of plans for review prior to installation of all automatic and fixed
fire extinguishing and detection systems. Specification sheets for each type of
device shall also be submitted for review.
Police Department
(7) An audible intrusion alarm shall be installed in the building.
(8) Post signs and paint driveways/curbs/parking areas red which have
emergency access lanes.
(9) The street numbers shall be displayed in a prominent location on the street
side of the property in such a position that the number is easily visible to
approaching emergency vehicles. The numbers shall be no less than 6 inches
in height and shall be of a contrasting color to the background to which they
are attached. The address numbers shall be illuminated during darkness.
(10) Exposed roof vents and ducts shall be grated or constructed of an impact
resistant material to the satisfaction of the Police Department. Skylights shall
be secured and hatch openings shall be burglary resistant. Glazing shall be of
a burglary resistant glass or glass -like material.
(11) Perimeter walls, fences, trash storage area, etc., shall be built to prevent access
to the roof or balconies.

(12) All exterior lighting shall be sufficient to establish a sense of well-being to the
pedestrian and one that is sufficient to facilitate recognition of persons at a
reasonable distance. Type and placement of lighting shall be to the
satisfaction of the Police Department.
(13) All exterior man doors shall be of solid core construction with a minimum
thickness of one and three fourths inches (1-3/4") or with panels not less than
nine sixteenth inches (9/16") thick. Side garage doors and doors leading from
the garage areas to private residences or multiple dwelling residences are
included in this requirement.
(14) Metal framed glass doors shall be set in metal door jambs.
(15) Metal framed glass doors shall have a dead bolt lock with a cylinder guard and
hardened steel throw that is a minimum of 1 inch long.
(16) Exterior jambs for doors shall be so constructed or protected so as to prevent
violation of the function of the strike plate from the outside. The strike plate
shall be secured to the jamb by a minimum of two screws which must
penetrate at least 2 inches into the solid backing beyond the jamb.
(17) Exterior doors that swing outward shall have non -removal hinge pins.
(18) In -swinging exterior doors shall have rabbited jambs.
(19) Glass on exterior doors or within 40 inches of an exterior door shall be break
resistant glass or glass -like material to the satisfaction of the Police
Department.
(20) All windows within 12 feet of the ground level shall have a secondary lock
mounted to the frame of the window. The secondary lock shall be a bolt lock
and shall be no less than 1/8 inch in thickness. The lock shall have a
hardened steel throw of 1/2 inch minimum length.
(21) Louvered windows shall not be installed within 8 feet of the ground level.
(22) Any window in or within 40 inches of an exterior door shall be stationary and
non -removable.
(23) Landscaping shall not block or obstruct the view of any door, window, or
lighting fixture.
(24) Any alternate materials or methods of construction shall be reviewed with
the Crime Prevention Officer before installation.
(25) The Crime Prevention Officer shall be allowed to inspect and approve the
construction prior to occupancy.

Public Works Denartment
(26) An engineered site improvement plan showing all existing and proposed site
conditions shall be submitted with the application for a building permit.
(27) A level "B" soils report shall be submitted with the application for a building
permit.
(28) Grading, drainage and foundation plans shall be reviewed and approved by
the project soils engineer. A final construction report shall be submitted by
the project soils engineer prior to occupancy.
(29) All earth and foundation work shall be done under the direction of the
project engineer. A final construction report shall be submitted by the project
soils engineer prior to occupancy.
(30) The final finish floor elevation shall be at elevation +8.0 (NGVD) after 30
years settlement. Certification of this elevation by a registered engineer or
land surveyor is required prior to occupancy.
(31) The improvement plans shall show all existing and proposed drainage
facilities.
(32) Runoff from improved areas shall be collected and conveyed to the street or
established drainage facilities or underground conduit.
(33) The improvement plans shall show the location of all existing and proposed
sanitary sewer facilities.
(34) Any work in the public right of way requires an encroachment permit from
the Department of Public Works.
(35) The improvement plans shall show all proposed and existing frontage
improvements.
(36) Any existing curb, gutter and sidewalk damaged during construction shall be
replaced to the satisfaction of the City Engineer.
(37) All frontage improvements shall be constructed in accordance with the
"Uniform Construction Standards for the Cities and County of Marin."
(38) All utility services shall be underground.

Planning Devartment
(39) The building techniques, materials, elevations and appearance of this project,
as presented for approval, shall be the same as required for the issuance of a
building permit. Any future additions, expansions, remodeling, etc., shall be
subject to the review and approval of the Planning Department.
(40) Prior to issuance of a building permit, the applicant is to comply with the
conditions of the Marin Municipal Water District to obtain water service to
the new building.
(41) A traffic mitigation fee of $1146.00, adjusted according to the Lee Saylor
Construction Index to take into account changes in construction costs, shall be
paid at issuance of a building permit. This is based on a fee of $764.00 times 15
PM peak trips in September 1993 dollars.
(42) All mechanical equipment (i.e., air conditioning units, meters and
transformers) and appurtenances not entirely enclosed within the structure
(on side of building or roof) shall be screened from public view. The method
used to accomplish this screening shall be indicated on the building plans and
approved by the Planning Department prior to issuance of a building permit.
(43) All trash enclosures shall be constructed of concrete block or of masonry and
surfaced with the same material used for the main building.
(44) All landscaping shall be maintained in a healthy and thriving condition, free of
weeds and debris. Prior to building final, the applicants shall provide a two year
maintenance contract for landscaping or post a two year maintenance bond.
(45) A letter from an acoustical engineer shall be submitted prior to building
permit issuance. The letter shall outline the methods necessary for
compliance with the standard of 50 Ldn in the office area. The acoustical
engineer shall monitor the construction and inspect the building prior to
occupancy to verify compliance with the noise standards.
(46) Street trees on the basis of one tree for each 30 feet of street frontage shall be
required for this project and shown on the landscape plan. The minimum tree
size shall be 15 gallon, six feet tall planted, and have a trunk caliper of at least
one -inch.
(47) Storage of building or contractors materials shall not be allowed outside of the
warehouse.
(48) Before issuance of a building permit, a lighting plan shall be approved by the
Planning Department.
(49) This design review approval shall be valid for two years from approval or
until October 24, 1997, and shall be null and void if a building permit is not
issued or a time extension granted.
