• Support the TAM Board's December 1St, 2016 action to
pursue State legislation in 2017 to provide an
exemption to the 2% cap on the local transaction and
use taxes.

Exemption to the 2% Sales Tax Cap
• Seeking an exemption to the 2% cap allows TAM,
local jurisdictions and the public to consider the
pursuit of a new sales tax measure dedicated for
transportation purposes, allowing maximum
flexibility on what is offered to the public to decide
upon.

• Supporting TAM in seeking legislative approval for
an exemption to the sales tax limit for Marin
County does not automatically increase the sales
tax for Marin County.
Future action will be before the Council regarding
approval of an Expenditure Plan, and placing a
measure on the ballot.

Provide an opportunity
• The TAM Board is considering asking the
community if they want to raise the sales tax to
fund critical transportation needs. A ballot measure
with a 2/3rds majority approval would be required
to renew the current sales tax or increase it.
• Amount of that higher sales tax has yet to be
determined- what are the needs and what level of
revenue is necessary to meet those needs.

operation of ongoing programs
(Local Transit, Safe Routes to
School, Local Road Maintenance)
• 13.25% (Major Roads Projects) and
7.5% (Hwy 101 Gap Closure) could
be reassigned in a sales tax renewal

Exemption to the 2% Sales Tax Cap
• Without the first step of an exemption to the
existing cap, Marin is limited in giving the publican
opportunity to decide
• This procedural step allows a community
conversation to consider expanding the sales tax to
address local transportation needs- several more
steps will need to occur before going to a ballot.

City Decision later on
• TAM is required by state law to receive approval by
its member jurisdictions of a sales tax expenditure
plan for any renewed sales tax or new sales tax.
• TAM would create an Expenditure Plan Advisory
Committee with broad membership who would
create a Draft Expenditure Plan. They would meet
from June 2017 through December 2017. All
meetings would be open to the public.
• TAM would take that Draft Expenditure Plan to
each city, town, and the county for approval — in
Spring 2018.

Legislative Pathway Available
• The Governor has approved several sales tax cap
increases for specifically filling transportation needs
• The Governor has not routinely approved raising of
the cap for general purposes

Recommendation:
• Support the introduction of legislation in February
2017 to provide an exemption of up to 0.5% above
the existing 2% cap
• Senator McGuire is a likely sponsor
