WHEREAS, the City Council was previously apprised of the $110,000 cost overruns associated with this project at the Council meeting of October 3, 1994; and WHEREAS, the design engineer, CH2M Hill, has been successful in keeping within the original cost overrun estimate; and WHEREAS, additional work tasks are required in order to complete the design that has recently been mandated; and and standards. WHEREAS, said work tasks amount to an estimated $28,500; WHEREAS, staff finds the cost estimates to be within industry NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council authorize the Director of Public Works to amend the professional services agreement with CH2M Hill for the Lucas Valley Interchange Improvements Project in the amount of $138,500. FOR THE LUCAS VALLEY ROAD / U.S. 101 INTERCHANGE IMPROVEMENTS This Amendment No. 2 is made and entered into this 21st day of August, 1995 by and between the City of San Rafael, a municipality in the County of Marin, State of California (hereinafter called "CITY") and CH2M Hill California, Inc., a corporation in the State of California (hereinafter called "CONSULTANT"). This Amendment No. 2 shall amend the previous Agreements dated October 3, 1988, and Amendment No. 1 dated June 17, 1991. Amendment No. 2 shall increase the Scope of Services for Final Design as per Attachment "A" (letter dated July 26, 1995) and City of San Rafael Resolution No. 9435. We are requesting a fee increase of $138,500 as compensation for excessive Geometric Approval Drawing (GAD) revisions and additional tasks that are necessary because of recent changes in Caltrans requirements. The numerous GAD revisions account for $110;000 of the fee increase. These were at Caltrans' request and are detailed in our June 30, 1994, letter. In general, the GAD cost overruns can be attributed to the development, analysis, and evaluation of a number of different alignment alternatives, each of which could not meet all of the Caltrans standards and design criteria, primarily because of the fact that we are retrofitting an existing interchange and not designing a new interchange that would typically have fewer constraints. The remaining $28,500 is to accommodate new and revised Caltrans requirements and to perform additional drainage design that Caltrans has requested. We were notified, by Caltrans, of these extra work items as part of their review of the 60 percent plans. These items are discussed below. 1. Caltrans now requires testing for aerial lead deposition. We recommend that a testing contractor be hired by the City to determine the extent of any lead contamination of the soil on the project site. We will provide necessary information and direction so that the testing contractor can do the work. We will then incorporate the mitigation measures that are developed into the project plans, specifications, and estimate. We expect to prepare at least two additional plan sheets that show the location and quantity of any contamination, as a result of this requirement. 2. Plan sheets showing the stormwater pollution prevention plan are now required for Caltrans District 4 projects. Previously these plans were not drafted and formally submitted. High-risk utilities must now be potholed and the horizontal and vertical alignments must be shown on the plans. It will be necessary to perform additional field surveying to tie in the potholed utilities and additional engineering and drafting effort to show the added information on the plans. 4. Revisions in the latest update to the Caltrans Highway Design Manual dated February 13, 1995, will require changes to all of the superelevation diagrams. 5. The scope of the drainage design has increased from what was originally planned. The reason for this is that the existing drainage systems that the project drains to (the 6'x 3' RCB and the 24" and 30" RCP's) are substandard. The implications of this are that Caltrans has required the evaluation of the existing drainage system beyond the limits of the project and that a more involved analysis of the proposed storm drain system be performed. The estimated costs for these additional extra work items are as follows: Aerial Lead Testing $11,000 Stormwater Prevention Plan $10,000 High -Risk Utilities $3,000 Revise Superelevation Diagrams I $1,500 Drainage Design $3,000 Total $28,500 I would like to point out that CH2M HILL has already absorbed cost overruns totaling over $20,000. These costs are attributed to travel expenses and extra work on the Materials Report, and are additional to the $138,500 being requested. The extra work on the Materials Report accounts for the majority of the overrun. This was due to the same type of problems we had on the GAD's. Caltrans requested seismic refraction work to be done which caused work for us as well as for Miller Pacific. Most of the extra work involved resolution of comments on the draft report. This included several meetings and many phone conversations with Caltrans staff to discuss and resolve review comments on the report when our scope of work allowed for one meeting. Our experience on numerous past projects had shown this to be adequate. In addition, it should be noted that we have not requested a fee increase for labor rate increases that have ocurred since we originally budgeted the project in 1991. The problems we have had with Caltrans reviews on this project are unique in our experience. Despite the past problems, I expect the project to move ahead efficiently now that the design has been clearly defined. With this letter, we are requesting that you take this matter before City Council, as soon as possible, for approval of an amendment to our contract in the amount of $138,500. It is our understanding that you are in agreement with this course of action and we are proceeding with work on the project based on this assumption. Please call me if you have any questions.
