RESOLUTION AUTHORIZING THE DESTRUCTION
OF CERTAIN POLICE DEPARTMENT DOCUMENTS
WHEREAS, the Police Department has limited storage space; and
WHEREAS, the Police Department has maintained certain files which are outdated and
no longer used including Charitable Solicitation files, Old Warrant information
files, Crime Statistics files, false burglar alarm activation records, expired
Concealed Weapons Permits files, applications for Amusement Center files,
Fortune Telling/Reading files, Billiard Room files, Explosive Permit files, Private
Security Patrol files, ResidentiaUCommercial Security files, and Crime Prevention
records; and
WHEREAS, the Police Department no longer requires use of the files; and
WHEREAS, California Government Code section 34090, with limited exceptions,
authorizes the Head of a Department, with the approval of the Legislative Body,
by Resolution, and written consent of the City Attorney, to destroy any City
record, document, instrument, book, or paper under his charge without making a
copy thereof if the same is no longer required and more than two (2) years old.
NOW, THEREFORE, BE IT RESOLVED that the Chief of Police is authorized to
destroy the above indicated records that are more than two years old.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, do hereby certify that
the foregoing Resolution was duly and regularly introduced and adopted at a
regular meeting of the City Council of the City of San Rafael held on the 6th
day of septembez 1994, by the following vote, to wit:
