RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING DRUG FREE ZONES NEAR SCHOOLS, PARKS AND YOUTH
CENTERS
WHEREAS, the sale of drugs to children is particularly deplorable in that it destroys
young lives and has disastrous effects on families and communities, as well as the future
of the nation; and
WHEREAS, the United States Code, Sec. 841, 845, 845(a), and 860 of Title 21
provide for enhanced penalties for persons who distribute drugs to individuals under the
age of 21 or who distribute drugs within 1,000 feet of schools, swimming pools and other
youth centers; and
WHEREAS, California Health & Safety Code Secs. 11353.1, 11353.6, and 11380.1
provides for enhanced penalties for persons 18 years of age or older who distribute drugs
to minors within 1,000 feet of schools; and
WHEREAS, California Health & Safety Code Sec. 11353.7 provides for enhanced
penalties for persons 18 years of age or older who distribute drugs to minors within public
parks; and
WHEREAS, the City of San Rafael may request, through the U.S. Attorney
General's Office, federal prosecution of violators of Secs. 841, 845, 845(a), and 860 of Title
21 of the United States Code; and
WHEREAS, in cases not prosecuted by the U.S. Attorney, the City of San Rafael
will request the Marin County District Attorney to enhance penalties per the California
Health & Safety Code Sec. 11353.1, 11353.6, 11380. 1, and 11353.7;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Rafael hereby approves the establishing of "Drug Free Zones" within 1,000 feet of public
and private schools, in public parks, and at public swimming pools and youth centers;
BE IT FURTHER RESOLVED that by copy of this resolution the U.S. Attorney's

Office will be advised of the City of San Rafael participation in the war against drugs and
encourage federal prosecution to the maximum extent possible for all drug offenders
violating the City of San Rafael's "Drug Free Zones";
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the
Marin County District Attorney's Office;
BE IT FURTHER RESOLVED that the Chief of Police is authorized to acquire and
post "Drug Free Zone" signs at appropriate places at a cost determined by him to be
reasonable.

the foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the City Council of said City held on Tuesday, the 22nd day of February, 1994,
by the following vote, to wit:
