BACKGROUND: On November 29, 2015, a Memorandum of Understanding (MOU) was adopted among the Sonoma -Marin Area Rail Transit District ("SMART"), the Marin County Bicycle Coalition ("MCBC"), the Transportation Alternatives for Marin ("TAM"), the County of Marin ("County"), and the City of San Rafael. The MOU affirmed, "all Parties desire to cooperate to study options for and implement a multi -use pathway between Second St. and Andersen Dr." TAM supported the feasibility study which was performed by Alta Planning + Design (Alta) which showed that while there are challenges with the installation of a multi -use path, it is possible to install a pathway from Second Street to Rice Drive. The feasibility study concluded that right-of-way issues and environmental clearance would need to be further clarified for any of the proposed pathway alignments. Following the feasibility study, the City of San Rafael pursued a contract with Alta to develop a plan for the alignment to Andersen Drive and initiate the environmental review process for the proposed pathway. Alta is currently working on design, environmental review and permit compliance. Based on the current preliminary designs, the project cost is estimated to be approximately $4,000,000. The City of San Rafael is currently seeking funding to support the project. The Transportation Authority of Marin (TAM) initially has allocated $250,000 and Metropolitan Transportation Commission (MTC) has allocated $1,000,000 for this project, which leaves a funding shortfall of approximately $2,750,000. The California Natural Resources Agency, Urban Greening Program (Program) has requested grant proposal for projects that reduce greenhouse gas emissions. The Program allocation is roughly $80,000,000; a minimum of 75% of these funds are to be distributed to projects within a disadvantaged community as defined by Senate Bill 535 (SB535). The remaining 25% may go to any project, but projects that meet Senate Bill 859 (SB859) disadvantaged community requirements will be given a statutory priority. Currently, San Rafael communities do not meet the criteria of a disadvantaged community as defined in SB535. SB859 disadvantaged communities are areas that have a median household income less than 80% of the statewide average. There are two communities within San Rafael that qualify as SB859 disadvantaged communities. These communities include the Canal District and parts of Downtown. While these two communities do not qualify the project to be eligible for 75% of the available funds, they do give the project a statutory priority for the remaining 25% of available funds. In an effort to secure funding through this grant program, the City is required to submit a City Council resolution approving the grant application. Staff recommends moving forward with adopting the attached resolution to apply for additional funding for this project. ANALYSIS: City staff has prepared the material required for the referenced grant application and we submitted the application on May 1St, including a draft of the required resolution pending approval by City Council. Without the final approved resolution, the Grant application will be considered incomplete and will not be further considered. Accordingly, the attached resolution is intended to cover the following: 1. The San Rafael City Council approves the filing of the Urban Greening grant application for the Second Street to Andersen Drive Multi -Use Pathway Project. 2. The San Rafael City Council authorizes the Director of Public Works to conduct all negotiations, agreements, and payments request necessary for the completion of the project. 3. The City Clerk is directed to record the resolution. Following the submittal of all necessary paperwork for this grant, the Urban Greening program is expected to make a recommendation of grant award in August of 2017. FISCAL IMPACT: Approval of the Application for Grant Funds for California Climate Investments Urban Greening Program is expected to have no negative fiscal impact on the City. The Urban Greening program does not require matching funds; however, having other funding sources for a project helps to allow our project to become more competitive in the selection process. If the grant is awarded for this project, up to $2,670,960 of funding could be provided to the City for use on completing the multi -use pathway. OPTIONS: The Council has the following options to consider in this matter: 1. Adopt the resolution as presented, approving filing of the grant application and authorizing the Director of Publics Works to conduct all negotiations, agreements, and payment requests necessary for the completion of the project; 2. Provide direction to staff for modification of the resolution; 3. Reject the resolution, which will cause the application to remain incomplete and disqualify the City from receiving the grant funding. ACTION REQUIRED: Adopt the Resolution ATTACHMENTS: 1. Resolution RESOLUTION NO. 14328 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE CALIFORNIA CLIMATE INVESTMENTS URBAN GREENING PROGRAM FOR THE SECOND STREET TO ANDERSEN DRIVE MULTI -USE PATHWAY WHEREAS, the Legislature and Governor of the State of California have provided grant funds for the "California Climate Investments Urban Greening Program"; and WHEREAS, the California Natural Resources Agency has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the California Natural Resources Agency require a resolution certifying the approval of application(s) by the Applicant's governing board before submission of said application(s) to the State; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the Project. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of San Rafael: 1. Approves the filing of an application for grant funds for the Second Street to Andersen Drive Multi -Use Path Project; 2. Certifies that applicant understands the assurances and certification in the application; 3. Certifies that applicant or title holder will have sufficient funds to operate and maintain the project consistent with the land tenure requirements; or will secure the resources to do so, and 4. Certifies that it will comply with the provisions of Section 1771.5 of the State Labor Code; 5. If applicable, certifies that the project will comply with any laws and regulations including, but not limited to, legal requirements for building codes, health and safety codes, disabled access laws, environmental laws and, that prior to commencement of construction, all applicable permits will have been obtained; 6. Certifies that applicant will work towards the Governor's State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1, and 7. Appoints the Director of the Department of Public Works, or designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project(s).
