A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL WAIVING USE PERMIT REQUIREMENTS
AND AUTHORIZING EMERGENCY USE OF CATHOLIC
CHARITIES BUILDING, 179 LOS RANCHITOS ROAD,
SAN RAFAEL, TO HOUSE HOMELESS PEOPLE
WHEREAS, due to the extremely cold temperature, the Marin
Housing Center's armory is fully occupied and unable to house any
more homeless persons; and
WHEREAS, there is a real likelihood of death or injury to
homeless persons as a result of overexposure to the elements; and
WHEREAS, Catholic Charities has requested an emergency
permit allowing them to use 179 Los Ranchitos Road as an emergency
shelter to house the homeless; and
WHEREAS, there is insufficient time to receive and
process Catholic Charities' application for a use permit to operate
an emergency shelter as required by the Zoning Ordinance;
NOW, THEREFORE, BE IT RESOLVED that the City Council
hereby waives the requirements to secure a use permit to operate an
emergency shelter at 179 Los Ranchitos Road;
BE IT FURTHER RESOLVED that this waiver is granted based
upon the following conditions:
(1) This Resolution shall be applicable to this emergency
shelter operation, and also the Faith Lutheran Church, if needed
for the overflow, from January 24 to January 29, 1992, at 8:00
a.m., with authority granted to the Mayor and City Manager to
extend if alternate sites have not been found and weather
conditions continue, but not to extend beyond February 3, 1992; and
(2) The shelter shall be operated by the Marin Housing
Center as an extension of the armory's program; and
(3) All program rules, policies and procedures of the
armory program shall apply at 179 Los Ranchitos; and

(4) Temporary residents shall be bused in and out of the

(6) Food will be delivered to the site, but it will not
be prepared on the site; and

(7 ) At all times during the operation, the Housing Center
will have at least one of its staff at this site.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at an special meeting of the City Council of
said City held on Friday, the 24th day of January, 1992, by the
following vote to wit:
