RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING UP89-
68(C), USE PERMIT AMENDMENT TO ALLOW THE EXPANSION OF AN
EXISTING POOL ROOM INTO AN ADJACENT TENANT SPACE AT 555
FRANCISCO BLVD. (HARBOR CENTER)
WHEREAS, a use permit amendment application was submitted to allow the
expansion of an existing pool room into an adjacent tenant space at the
Harbor Center Shopping Center; and
WHEREAS, the Planning Commission reviewed the proposed project at the
regular meeting of March 26, 1991, received the planning staff report
recommendation and public testimony, and voted to approve said
application.
NOW THEREFORE BE IT RESOLVED that the San Rafael City Council
approves UP89-68(C) based on the following findings:
1. The proposed location of the conditional use is in accord with the
objectives of this title, and the purposes of the district in which the
site is located. The operation of the proposed billiard room together
with the conditions of approval is consistent with the General Plan
land use designation of Marine Related. Furthermore, billiard
rooms (commercial recreation uses) are conditionally permitted in
the M (Heavy Commercial and Manufacturing) zoning district and
this use is in accord with objectives of the zoning code. The billiard
room, as proposed, is consistent with all the regulations of the San
Rafael Municipal Code, Chapter 10.28 (Billiard Rooms and Pool
Rooms).
2. As conditioned, the establishment, maintenance or operation of the
proposed billiard room will not under the circumstances of the
particular case, be detrimental to the health, safety, peace, morals,
comfort and general welfare of persons in the neighborhood of such
proposed use or be detrimental or injurious to property and
improvements in the neighborhood or the general welfare of the
City in that required parking for the use is provided on-site and
security personnel for driveway and parking lot areas will be
provided between the hours of 11:00 PM and 2:00 AM.

well reported that the applicant proposes a use permit amendment to expand the
existing billiard room operation into an adjacent tenant space. The proposal
involves the demolition of an interior wall between the existing billiard room
and the project site. Bell noted that the demolition will facilitate the
installation of four tables in the additional space. She showed the floor plan
on the screen, and added that the applicant proposes no changes to the daily
operations of the billiard room as approved by the City Council. They are open
seven days a week from 12 PM to 2 AM, and serve sandwiches and nonalcoholic
beverages. She added that staff is recommending that the Commission recommend
approval to the City Council.
Scott inquired about security, and whether the Police Department has concerns
regarding the two entrances. Bell responded that the Police Department's only
concern was that all tables can be seen from the street, and that is the reason
the wall between is being demolished.
Bellatorre stated that the video games block the windows, and she recommended
that staff ask the Police Department if they qualify as a blocking device.
Bell stated she will check, and have the owners move the video games if it is a
problem.

Pendolev informed the Commission that since they had heard this proposal in May
of last year the owner h s hired another architect, who has come up with a very
fine solution for the seco dwelling unit with which the neighborhood is very
positive.
Hillegas reported that the applicantoriginally proposed to raise the existing
residence to accommodate a 500 sq. ft. Gond dwelling unit underneath.
However, the Design Review Board recommende` approval of the project provided
that the house not be raised and that the lands ing be improved.
H1Ie9a stated that the new architect is proposing to a one -bedroom second
unit to the rear of the existing structure and over a new two -car garage. The

SITE CHARACTERISTICS:
Site Description:
The proposed business would be located on a 95,832 sq. ft. (2.2 acre) property developed
with a 30,000 sq. ft. commercial building, which fronts on Francisco Boulevard East.
Tenants in the Center include: Carpet World, Supercuts, Applied Computer
Technology, Taqueria Zacatecana Restaurant, Video Lab and India Village Restaurant.
Six of the 13 tenant spaces are currently vacant (10,248 sq. ft.) One of the currently
vacant tenant spaces (#14-1,640 sq. ft.) would be occupied by the proposed billiard room
(see Exhibit B). There are 142 on-site parking stalls located to the rear and east side
(north) property line. Adjacent to the west property line is an existing boat harbor.
Numerous motor vehicle service uses are located along Bay Street, adjacent to the
subject property's west property line.

BACKGROUND:
On December 12, 1989, the Planning Commission recommended to the City Council,
approval of a use permit (UP89-68) establishing a billiard room. The use permit was
conditionally approved by the City Council on January 2, 1990. The City Council
approved the use permit for six months, or until June 12, 1990. Condition (14) of the
permit states that prior to expiration, the applicant shall submit a time extension
request which the Planning Commission shall evaluate the use for compliance with
conditions of approval and insure that the conduct of business does not adversely
affect surrounding property owners, tenants and the general public. The applicant
submitted a time extension application on May 17, 1990. The Planning Commission
reviewed and approved the time extension application on June 26, 1990. The Planning
Commission's approval of the time extension application was based on a favorable
response from the Police Department which had not received any calls or complaints
regarding the operation of the billiard room.
The use permit (UP89-68) approved by the City Council, allows the operation of a
billiard room with 11 tables, between the hours of 12:00 PM to 2:00 AM, seven days a
week. A 500 sq. ft. refreshment area, providing sandwich and beverage service
(nonalcoholic) to patrons of the billiard hall, is located adjacent to the entrance of the
establishment (see Exhibit Q. One employee (the applicant) operates the business
Sunday through Thursday. On Friday and Saturday, 2 employees are present. The
billiard room currently operates in tenant space #13 (see Exhibit B).
PROTECT DESCRIPTION:
The applicant proposes a use permit amendment to expand the existing billiard room
operation into an adjacent tenant space (#14 - see Exhibit B). The proposal involves
the demolition of an interior wall between the existing billiard room (tenant space
#13) and the project site (tenant space #14). The demolition will facilitate the
installation of four tables in tenant space #14. The merger of tenant spaces will
accommodate the use of a total of 15 tables (11 tables previously approved by UP89-68)
for patrons of the Marin Billiard Club. The applicant proposes no changes to the daily
operations of the billiard room, as approved by the City Council in UP89-68.
ANALYSIS:
General Plan 2000 Consistencv:
Staff concludes that the proposal is consistent with the land use designation of Marine
Related. This designation allows water dependent businesses such as boat building,
boat repair, sales and service uses, marinas and boat charter services, shopping centers,
restaurants, hotels/motels, and parks that draw people to the waterfront. A billiard
room is categorized as a commercial recreation land use. The General Plan land use
designation of Marine Related does not specify commercial recreation uses as
permitted. Staff recommends that the proposed billiard room is consistent with the
land use designation in that commercial recreation uses such as bowling alleys, movie
theaters, ice rinks and roller -rinks are typically found in shopping centers. As

previously stated, shopping centers are permitted uses in the Marine Related land use
category designation.
General Plan 2000 Policy "S-23" states "crime prevention and fire prevention
techniques shall be required in new development. Police and Fire Department
personnel shall continue to review development applications to insure that
landscaping, lighting, building siting, design, adequate water pressure and peakload
storage capacity and building construction materials reduce the opportunity for crime
and fire hazards." A description of the proposed use and site plan, as submitted, were
forwarded to both the Police and Fire Departments for review. These departments
evaluated the proposal and submitted conditions of approval which reduce the
opportunity for crime and fire hazards.
Regarding the Zoning Ordinance, the subject site is currently located in an M (Heavy
Commercial and Manufacturing) District in which billiard room uses are allowed
upon securing a conditional use permit from the City. While the "M" District does not
specify that billiard rooms are allowed by use permit, Section 14.56.025(i) of the Zoning
Ordinance states that all uses listed in any chapter of the Zoning Ordinance as being
permitted uses or subject to approval by use permit may be allowed. As previously
stated, billiard rooms are classified as commercial recreation uses in the zoning district.
Commercial recreational uses are permitted uses in several zoning districts.
Municipal Code Chanter 10.28:
Section 10.28.010 (see Exhibit F) requires that the City Council of San Rafael approve all
permit applications for public pool or billiard rooms. This ordinance was adopted in
1966 and establishes specific regulations with which billiard rooms are obligated to
comply. The ordinance states the following: the billiard room shall be closed between
the hours of 2:00 AM and 6:00 AM; all games of billiards shall be carried on in plain
view of all persons; persons under the age of 16 are prohibited in the establishment
unless accompanied by a parent or similar authority; alcoholic beverages are
prohibited; and all regulations contained in Chapter 10.28 shall be posted in the
establishment. Staff recommends that the use permit proposal, as conditioned, is
consistent with this Municipal Code. Staff has incorporated sections of this chapter
into the conditions of approval for the project.
Parking;
Staff's analysis on parking requirements is broken into two categories, day and evening
uses. The list of current tenants in the shopping center appears on Exhibit E. All the
businesses in the center are open during the day.

Section 14.13.140 of the San Rafael Zoning Ordinance requires that shopping centers
over 20,000 sq. ft. of gross floor area provide four parking spaces for each 1,000 sq. ft. of
gross area. Therefore, the Harbor Center, 30,000 sq. ft. in gross area, should have 120
on-site parking stalls. The Harbor Center currently provides 142 on-site parking shalls,
22 more than required by ordinance. The expanded billiard hall is proposed to be
located in a 1,640 sq. ft. tenant space. The parking requirement for a retail/service day
use in this tenant space would be 7 stalls (4/1,000 sq. ft. of gross floor area). Billiard
rooms require one stall per table. Therefore, the proposed use, requiring 4 stalls, is less
intensive than a retail/service day use in this tenant space.
With respect to evening uses, staff recognizes that theTaqueria Zacatecana Restaurant
and India Village Restaurant require more parking than four stalls per 1,000 sq. ft. of
gross area. Therefore, staff has prepared a parking analysis based on the parking
demand for evening uses. The businesses open in the evening are India Village
Restaurant, Taqueria Zacatecana Restaurant and the proposed Marin Billiard Club.
The parking standard for restaurants and bars/nightclubs is one parking stall per 50 sq.
ft. of floor intended for public use or one parking stall for every four seats, whichever
is greater. Per this standard, Taqueria Zacatecana Restaurant with approximately 1,000
sq. ft. of public floor area (40 seats) requires 20 parking stalls and India Village
Restaurant With approximately 1,500 sq. ft. of public floor area (60 seats) requires 30
parking stalls. The parking standard for billiard rooms is one parking stall per table, so
the Marin Billiard Club would require 15 parking stalls. The total parking demand for
evening use is 65 parking stalls, where 142 on-site stalls exist. Therefore, there is a
surplus of 77 parking spaces on-site.
Staff notes that the two restaurants in the center will not be open after 10:00 PM. In
addition, the majority of the Marin Billiard's clientele will occupy these businesses
after the hours of 10:00 PM. Therefore, parking demand for the center will be further
reduced after 10:00 PM.
Parking Lot Securitv
The Police Department has not received any calls or complaints concerning the
existing billiard room and does not anticipate any problems with the proposed
expansion. Condition (13) requires the operator of the billiard room to provide
periodic security checks in the driveway and parking lot area every 1/2 hour between
the hours of 11:00 PM and 2:00 AM. If at any time problems arise, concerning the
billiard room operation, security requirements may be increased to protect the public
health, safety and general welfare.
Environmental Review:
This project has been reviewd in accordance with the California Environmental
Quality Act and has been found to be categorically exempt under Section 15301; existing
facilities.

the hours of 11:00 PM and 2:00 AM.
CONDITIONS OF APPROVAL:
Police Department
(1) Meetings with the owner or owners of this business may be called by the Police
Department at their discretion.
(2) This addition of use is binding to all future owners.
Public Works Department
(3) Exiting shall comply with the requirements of the Uniform Building Code.
Planning Department
(4) This use permit approves the business operation of a 15 -table billiard room,
with a 500 sq. ft. refreshment area. The business shall be located in tenant spaces
#13 and #14 of the Harbor Center, as depicted on Exhibits B, C & D.
(5) The serving or consumption of alcoholic beverages shall be prohibited.
(6) The billiard room shall remain closed between the hours of 2:00 AM and 6:00
AM, consistent with Chapter 10.28 of the Municipal Code.
(7) A valid business license shall be maintained at all times.
(8) The food service provided shall be incidental to the use and shall only serve
patrons of the pool hall.
(9) All games of pool or billiards played therein shall be carried on in plain view of
all persons, unobstructed by screens, blinds, stained windows, or other devices.
(10) Persons under age 16 years shall not be permitted of participate in any game of
pool or billiards, or to loiter in, around, or remain in and about the billiard
room premises unless employed therein or unless accompanied by a parent,
parents, guardian, teacher, instructor, or one occupying a similar capacity of
authority over such person or persons under the age of 16 years. Persons 16
years old and under the age of 18 shall not be permitted in the billiard room
establishment after 11:00 PM, consistent with City of San Rafael curfew hours for
minors.

(11) The operation of the billiard room shall comply with all regulations of
Municipal Code Chapter 10.28 (Billiard Rooms and Pool Rooms) for the life of
the use permit.
(12) All regulations contained in Chapter 10.28 of the Municipal Code shall be posted
and at all times kept posted in each room of the billiard room. Failure to post
and keep posted such regulations shall be deemed a violation of Chapter 10.28.
(13) The operator of the billiard room shall provide security checks in the driveway
and parking lot every 1/2 hour between the hours of 11:00 PM and 2:00 AM to
protect the public health, safety and general welfare of people and property in
the area. If at any time, problems arise concerning billiard room operation,
security requirements may be increased.
(14) This use permit is approved for two years, or until March 26, 1993. Prior to
expiration, the applicant shall submit a time extension request which the
Zoning Administrator shall evaluate the use and for compliance with
conditions of approval and to insure that the conduct of business does not
adversely affect surrounding property owners, tenants and the general public.
The Zoning Administrator may grant a time extension upon completing its
review and apply any additional conditions.

10.28.010 Permit from council required. It shall be unlawful for any
person to conduct, carry on, operate or maintain in the City of San Rafael,
any public pool or billiard room, or rooms without first obtaining written
permit therefor from the Council of the City of San Rafael; and such per-
mit shall be required in addition to the license required by Section 10.04.490

10.28.020 Hours of operation. Any pool or billiard room or rooms
shall not be open, nor shall games be played or carried on therein between
the hours of two a.m. and six a.m. of any day. (Ord. 826 § 1; September 20,
1965: prior Ord. 73.)
10.28.030 Games to be open to view. Any pool or billiard room or
rooms must be conducted on a ground floor and have a glass front upon
the public street so that all games of pool or billiards played therein shall
be carried on in plain view of all persons, unobstructed by screens, blinds,
stained windows, or other device. (Ord. 73.)
10.28.040 Persons under age of sixteen years prohibited—Exceptions.'
It shall be unlawful for the proprietor, manager, clerk, or other person in
charge of any public pool or billiard room or rooms, to permit any person
under the age of sixteen years to participate in any game of pool or bil-
liards, or to loiter in, around, or remain in and about said premises unless
employed therein in response to a public advertisement therefor, or unless
accompanied by the parent, parents, guardian, teacher, instructor, or one
occupying a similar capacity of authority over such person or persons
under the age of sixteen years, as aforesaid.
It shall be unlawful for any such person under the age of sixteen
years to visit, loiter, or remain in such premises unless employed therein

10.28.050 Private rooms prohibited --Exceptions. It shall be unlawful
for any person conducting any pool or billiard room in the City of San
Rafael, or for any servant or employee of such person to have or maintain
in connection with such pool or billiard room or rooms, any private room
or rooms, excepting rooms used exclusively as toilets or lavatories; and for
the purposes of this chapter private rooms shall be deemed to be those
rooms the entire interiors of which are not exposed to view from the main
entrance to such pool or billiard room. (Ord. 73.)
10.28.060 Gambling in pool or billiard rooms prohibited. It shall be
unlawful for any person conducting any public pool or billiard room in
the City of San Rafael, or for any servant or employee of such person, to
permit, suffer or allow the playing of any game or games of chance or
skill, played with cards, dice or other device or devices and on the out-
come of which the Ioss or gain of money, merchandise, credit, checks or
other thing of value is hazarded, in or about any such public pool or bil-
liard room or rooms, or in any room or place adjacent thereto and con-
trolled by such person, and it shall be unlawful for any person to play or
bet at or against any of said game or games of chance of skill, played
with cards, dice or other device or devices and on the outcome of which
the loss or gain of money, merchandise, credit, checks or other thing of
value is hazarded. (Ord. 89.)
1U 28.070 Posting of Regulatious. Upon application therefor, printed
copies of the regulations established by this chapter shall be furnished by
the City Clerk to any person conducting a pool or billiard establishment in
the City of San Rafael. Such regulations shall be conspicuously posted
and at all times kept posted in each room of every pool or billiard estab-
lishment in the City of San Rafael by the person conducting the same, and
the failure to post and keep posted such regulations shall be deemed a
violation of this code. (Ord. 73. )
10.28.080 Revocation of hermit. The City Council may, at any time,
for such cause as they or a majority of them, upon investigation, deem
sufficient, revoke any permit granted under the provisions of this chapter,
and it is especially ordained and declared that all such permits are held
at the pleasure of the City Council. (Ord. 73.)
-10.28.090 Alcoholic beverages prohibited. It shall be unlawful for
the owner, operator, tenant, or person in control of any public pool or
billiard room, or rooms, or for any other person to possess intoxicating

liquor or alcoholic beverage in any public pool or billiard room and it shall
`-� be unlawful for any of said persons to sell, dispense, give, serve, or deliver
to any person within any public pool or billiard room any intoxicating liq-
uor or alcoholic beverage.
It shall be unlawful for such owner, operator, tenant, or other person
to permit any person to consume any intoxicating liquor or alcoholic bev-
erages within such public pool or billiard room or rooms. (Ord. 826 § 3;
September 20, 1965.)
