A RESOLUTION OF THE CITY COUNCIL OF SAN RAFAEL, APPROVING
THE ENVIRONMENTAL DESIGN REVIEW PERMIT FOR A NEW
MEDICAL OFFICE BUILDING AND THE PARKING AND CIRCULATION
PLAN FOR THE LOWER LOT ADJACENT TO THE MEDICAL OFFICE
BUILDING
(RE: ED90-44 - 99 MONTECILLO ROAD)

WHEREAS, on July 11, 1990, an application requesting an amendment
to the approved Master Plan Use Permit for the above referenced
Environmental Design Permit for the Medical Office Building, Service
Maintenance Building and Parking Structure was found by the Planning
Department to be complete for processing; and,
WHEREAS, upon review of the subject application in accordance with
the requirements of the California Environmental Quality Act (CEQA), an
Initial Study was completed by Planning staff; and,
WHEREAS, it was concluded in the Initial Study that the proposed Use
Permit Amendment and Environmental and Design Review Permit did not
have the potential for creating a significant impact on the environment; and,
WHEREAS, on April 23, 1991, the San Rafael Planning Commission
held a duly noticed Public Hearing on the proposed amendment to the
approved Master Plan Use Permit and the Environmental and Design
Review Permit application, accepted public testimony and the written report
of the Planning Department staff and determined that the proposed Medical
Office Building, Service Maintenance Building and Parking Structure did not
have the potential for creating a significant impact on the environment and
therefore Certified a Negative Declaration in accordance with the California
Environmental Quality Act; and
WHEREAS, on April 23, 1991, the San Rafael Planning Commission
held a duly noticed Public Hearing on the proposed amendment to the
approved Master Plan Use Permit and the Environmental and Design
Review Permit application, accepted public testimony and the written report
of the Planning Department staff and approved the proposed amendment to
the Master Plan Use Permit and the Environmental and Design Review of
the Service Maintenance Building and the Parking Structure; and
WHEREAS, the Condition (e) of the Master Plan Use Permit required
that the Medical Office Building and the parking and circulation plan for the
lower lot, adjacent to the Medical Office Building shall be reviewed by the
Design Review Board and Planning Commission, and approved by the City
Council prior to the issuance of building permits; and

WHEREAS, on May 20, 1991, the San Rafael City Council held a duly
noticed Public Hearing on the proposed Design Review application for the
Medical Office Building and the parking and circulation plan for the lower lot
adjacent to the Medical Office Building, accepting public testimony and the
written report of the Planning Department staff; and,
WHEREAS, the City Council determined that the Medical Office
Building and the parking and circulation plan for the lower lot adjacent to the
Medical Office Building was consistent with the General Plan in that the
Floor Area Ratio does not exceed the Floor Area Ratio designated for the use
in the Northgate Activity Center, and the additional trips required for the
building do not exceed the number of trips allotted to the site.
NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council finds
there is no substantial evidence in the record showing that the project could
have a significant effect on the environment and approves the
Environmental and Design Permit for the Medical Office Building and the
parking and circulation plan for the lower lot adjacent to the Medical Office
Building.

the foregoing Resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City on Monday , the 20th dayof
