HomeMy WebLinkAboutCC Resolution 8494 (General Plan Amendment)RESOLUTION NO. 8494 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CERTIFYING A NEGATIVE DECLARATION AND ADOPTING THE MISCELLANEOUS GENERAL PLAN AMENDMENT (GPA 91-1) WHEREAS, the 1991 Annual General Plan Evaluation reviewed by the Planning Commission and City Council contained several recommendations for potential General Plan amendments 1) land use map changes and text changes which staff has identified as a result of detailed draft Zoning Ordinance preparation; and 2) an updated traffic allocations listing in Appendix B which establishes a new "General Reserve" for public benefit uses, includes new Assessor Parcel numbers, and deletes properties that have been developed; and WHEREAS, the Council directed staff to proceed with these Plan amendments; and WHEREAS, notification of the proposed amendments occurred as specified by State law; and WHEREAS, staff identified the various amendments, with corresponding background analysis in the staff report; and WHEREAS, an environmental assessment for the proposed program and policy changes to the San Rafael General Plan 2000 resulted in a Negative Declaration of Environmental Impacts. The Negative Declaration was prepared on June 6, 1991, and no comments were received; and WHEREAS, the San Rafael Planning Commission is required by state law to hold at least one public hearing and make a written recommendation to the legislative body on the adoption of any Plan amendments; and WHEREAS, the Planning Commission held a public hearing on July 9, 1991, to hear public comments on the proposed amendments; and WHEREAS, the Planning Commission reviewed the staff report and written and verbal testimony on the Negative Declaration and the plan amendments; and unanimously recommended Council adoption of the Negative Declaration and plan amendment as contained in the August 5, 1991 City Council staff report; and WHEREAS, the San Rafael City Council is required by state law to hold at least one public hearing on the adoption of any Plan amendments; and 1 0f91UINNL f8y9-11 WHEREAS, the Council held a public hearing on August 5, 1991, and continued said public hearing to August 19, 1991 at the request of the Elks Lodge, to hear public comments on the proposed amendments; and WHEREAS, the Council reviewed the staff report and written and verbal testimony on the Negative Declaration and the plan amendments. NOW, THEREFORE, BE IT RESOLVED, the San Rafael City Council certifies the Negative Declaration and adopts the following package of General Plan amendments: A. LAND USE MAP CHANGES BY AREA These changes are proposed to the San Rafael Land Use Plan Map as a result of detailed zoning ordinance review to provide more appropriate land use designations and/or to reflect existing development. Overall, the proposed land use amendments reduce residential development potential on certain constrained sites, or better reflect existing uses. 1. Williams St. and Bradcliff near Mountain View in the Dominican area, twelve parcels 15- 081-12, -13, -14, -15, -16; 15-081-18, -19, -20, -21; 15-081-23; 15-081-28; and 15-112-17. Flat or gently sloping sites developed with 5,000 to 10,000 square foot lots. (Hillside Residential to Low Density Residential) This change would permit zoning consistent with existing lot sizes. 2. Clayton Street driveway extension toward Ross Street in the West End/Gerstle Park area, eight parcels 12-141-03; 12-141-45; 12-141-48; 12-141-51; 12-141-52; 12-141-58, -59, and -60. Steep wooded sites with poor access. (Medium Density Residential to Low Density Residential). This change would permit application of hillside design standards while minimizing nonconforming lot sizes. 3. Elizabeth Way/Valley View in Fairhills , eight parcels 10-011-02, 10-083-02, -04 and -05; 10-133-15; 10-301-24 and -25; and 179-261-27. Large, steep hillside sites with limited access. (Low Density Residential to Hillside Residential) 4. Sirard Lane in Sun Valley area, three hillside parcels with 30-35 percent slope, 10-011-28 and -53 and 10-052-40 (Parks/Open Space to Hillside Residential) and seven flat parcels 10- 011-51, -52, -54, -55; 10-052-01, -39, (Parks/Open Space to Low Density Residential). Both redesignation correct an error in an open space designation. 5. Elks Club property on Mission Avenue in the downtown area. Partly steep and wooded 10.56 acre site. (Undeveloped, rear 4.3 acre portion of the site changed from High Density Residential to Hillside Resource Residential; and undeveloped 1.3 acres to east and west of parking lot changed from High Density Residential to Hillside Residential). 6. Oakwood Drive in Fairhills, parcel 10-031-01. City -owned hillside site. (Residential to Parks/Open Space) 7. Los Ranchitos/Golden Hinde in Terra Linda, one flat parcel 175-292-26, the Ann Curtis Swim School property (Hillside Residential to Public/Quasi-Public); and one flat 1.39 acre parcel with five units, 175-292-35 (Hillside Residential to Low Density Residential). 8a. Red Rock Way in Terra Linda, 179-232-07, a 1.76 acre wooded parcel with 50 percent slope (Low Density Residential to Hillside Residential). 8b. Lincoln Avenue, four parcels 11-065-20, -21, -22, and -11 with existing office development on the east side of the north end of Lincoln Avenue. Small parcels adjacent to Highway 101, Lincoln Avenue off -ramp, and future transitway (High Density Residential to Residential /Office). 9. Los Gamos Road in Terra Linda. Terra Linda Garden condominium parcels on the west side of Lost Gamos Road currently used as landscaping and open space. One hillside parcel, 178-240- 14 (Parks/Open Space to Hillside Residential); and one flat parcel, 178-240-11 (Parks/Open Space to Low Density Residential). 10. Sessions Rise and Parkway Terrace condominiums in Northgate East, parcels 155 -210 -all and 155 -220 -all. Existing medium density residential development on hillside sites (High Density Residential to Medium Density Residential to reflect existing development). 11. 270 Channing Way in Northgate East, parcels 155-360-01 to -24. Existing medium density residential condominium development on a hillside site (High Density Residential to Medium Density Residential to reflect existing development). 12. Las Gallinas in Terra Linda, parcel 165-010-66. Near Cherry Hill, a highly -visible 2.95 acre hillside parcel with a 30 percent slope. Nearly surrounded by city -owned open space, with inadequate frontage along Las Gallinas (Low Density Residential to Hillside Residential). 13. 10 Bay Way in Loch Lomond area, a 4.2 acre parcel with one residence and a recorded restriction against further subdivision (Parks/Open Space to Low Density Residential and Conservation Area). 14. Four parcels in East San Rafael, 14-204-01, -02, -09, and -11. Existing commercial/motel uses on block bounded by Medway, Francisco Blvd., Hoag and Front Streets (General Commercial and Industrial/Office to General Commercial). TEXT MODIFICATIONS Additionally, amend San Rafael General Plan policies and Appendix B to update the plan, provide some additional flexibility for limited uses and clarify future preservation status of existing legal residential units as follows: 15. Increase flexibility in locating residential and office uses in the downtown core, West Fourth Street, and Miracle Mile from the second floor only, to rear ground level as well 16. Delete ESR -25, pertaining to an Auto Center, and the corresponding "A" on the land use plan map to recognize changed circumstances 17. Revise description of General Commercial uses to clearly permit office as secondary uses in General Commercial Districts except Francisco Blvd. West. 18. Clarify Policy C-4 to note that property trip allocations are updated periodically and to reference Bonus Trips and Trip Transfers. 19. Add new housing conservation policy consistent with other existing housing conservation policy to avoid confusing or convoluted nonconforming provisions in the new zoning ordinance. 20. Update housing program H-kk consistent with a prior East San Rafael Neighborhood Plan designation of City -owned property as a park, not residential. 21. Update the property traffic allocations listing in the General Plan Appendix to establish a new Northgate "General Reserve" as well as to provide updated parcel numbers, reflect existing partially developed projects, and eliminate properties which have been developed. BE IT FURTHER RESOLVED, that the City Council finds these recommended revisions to be in the public interest in that they help keep the Plan current; clarify wording of certain policies; modify land use designations consistent with site constraints, poor access and/or neighborhood character or existing uses; provide some additional flexibility for limited uses and clarify future preservation status of existing legal residential units; BE IT FURTHER RESOLVED, that the City Council finds, based on substantial evidence in the record, that designation of properties identified for the "Hillside Residential" or "Hillside Resource Residential" land use category is consistent with General Plan policies LU -10, NE -20 and RES -1. BE IT FURTHER RESOLVED that the environmental assessment relied on the prior General Plan EIR to identify impacts of the General Plan policies and land use designations and identified no significant new environmental impacts resulting from the new or revised policies, programs or land use designations; BE IT FURTHER RESOLVED, that upon review and consideration of the environmental assessment, the Council makes the following finding in accordance with Section 15092 of the CEQA guidelines: 3 This proposed amendment to the General Plan includes a minor reduction in the number of housing units from the San Rafael General Plan 2000 (Adopted July, 1988) for the following reason: Detailed site specific review as part of draft zoning ordinance preparation identified several hillside parcels where environmental constraints merit the lower land use designations.
