HomeMy WebLinkAboutCC Resolution 8260 (Civic Center North Office Site)RESOLUTION NO. 8 2 6 0 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DISPOSING OF EXCESS RIGHT OF WAY AT THE NORTHEAST CORNER OF THE CIVIC CENTER NORTH OFFICE BUILDING SITE ON McIlNTNIS PARKWAY; AUTHOR- IZING EXECUTION OF QUITCLAIM DEED; AND ACCEPT- ING CONVEYANCE OF ACCESS EASEMENTS IN EXCHANGE FOR DISPOSAL OF SAID EXCESS RIGHT- OF -WAY WHEREAS, Joe Shekou, developer of the Civic Center North office building site, has previously conveyed right-of-way to the City for construction of McInnis Parkway; and WHEREAS, subsequent to the conveyance of said right-of-way, the alignment of McInnis Parkway was revised, thus creating an excess portion of said right-of-way; and WHEREAS, a condition of approval of the office building (UP 89-60) required that the developer secure from the City the right to use said excess right-of-way to bring the project into conformance with the applicable General Plan Floor Area Ratio; and WHEREAS, Section 8355 of the Streets and Highways Code provides for the disposition of excess property by requiring that the City Council determine this property, which was previously subject to a street, is no longer needed by the public - in which case said Council may sell or exchange said property; and WHEREAS, the developer has offered to convey to City three access easements containing 0.537 acres required by City for access to a maintenance easement along Gallinas Creek in exchange for said excess right-of-way containing 0.2616 acres. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of San Rafael that: 1. The excess right-of-way as described in Exhibit "ONE" attached hereto which was previously subject to a street or highway is no longer needed by the public and that said Council shall dispose of said excess right-of-way to Joe Shekou in exchange for three access easements of comparable or greater worth to the City; 2. The Mayor and City Clerk are authorized to execute a Quitclaim Deed, as described in Exhibit "ONE" attached hereto, to Joe and Haidy Shekou for the disposal of said excess right-of-way; 1 ORIGINAL ,.mob RESOLUTION NO. 8260 3. The Grant Deed of easements as described in Exhibit "TWO" attached hereto, is hereby accepted for and on behalf of the City of San Rafael in exchange for the disposal of said excess right-of-way described above; 4. The City Clerk is hereby directed to cause said Quitclaim Deed and Grant Deed, along with this Resolution, to be duly recorded in the Office of the County Recorder of the County of Marin forthwith upon the adoption of this Resolution.
