A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL CERTIFYING A NEGATIVE
DECLARATION AND APPROVING THE
ANNEXATION AND PREZONING OF CERTAIN REAL
PROPERTY LOCATED AT 183 OAK DRIVE.
WHEREAS, an application was submitted to the Planning
Department for annexation to the City of San Rafael a certain parcel of
land in the County of Marin designated the "Oak Drive Annexation';
and
WHEREAS, the Local Agency Formation Commission by
Resolution 89-6, adopted March 9, 1989, made determinations and
approved said annexation of the .18 acre parcel, parcel number 186-153-
37; and
WHEREAS, the San Rafael Planning Commission held a public hearing on
October 13, 1990 to review the subject application, PreZ90-3, requesting that a 7,100
square foot parcel be prezoned prior to annexation by the City; and
WHEREAS, the area proposed to be prezoned is uninhabited and a
description of the property is set forth in Exhibit "A" attached hereto and by this
reference incorporated herein; and
WHEREAS, a Negative Declaration has been prepared determining that no
significant environmental impacts will result from this project; and
WHEREAS, the proposed prezoning is consistent with the General Plan land
use designation of Low Density Residential, the Zoning Ordinance and existing
improvements.

NOW THEREFORE BE IT RESOLVED that the San Rafael City Council hereby
certifies the Negative Declaration and approves the annexation based on the
following findings:
A. The territory to be annexed has been designated the "Oak Drive
Annexation" and its boundaries are as set forth in Exhibit A, legal description,
attached; (County Assessor's Parcel 186-153-37);
B. The territory is uninhabited.
C. The reasons for the proposed annexation are that the area is adjacent to
the City; municipal services can be provided effectively and economically by the
City; and the annexation is in conformance with the San Rafael General Plan
I, JEANNE M. LEONCI NI, Clerk of the City of San Rafael, California, hereby
certify that the foregoing resolution was duly and regularly introduced and adopted
at a regular meeting of the City Council of said City held on the 19th
day of November, 1990, by the following vote, to wit:

OAK DRIVE ANNEXATION
CITY OF SAN RAFAEL
Beginning at the most northerly corner of Lot 128, as
shown on that certain map entitled "Map of Bayside Acres, Marin
County, California.", filed April 29, 1911 in Volume 3 of Maps at
Page 71, Marin County Records, said point also being on the
existing boundary of the City of San Rafael and also on the
southeasterly right-of-way line of Oak Drive as shown on said map
of Bayside Acres; running thence along said right-of-way,
N 470 E 18.41 feet and N 12° E 17.36 feet;
thence leaving said right-of-way S 73° E 33.65 feet to the most
northerly corner of the lands shown in Book 11 of Parcel Maps at
Page 5, Marin County Records;
thence S 290 06' E 142.87 feet;
thence S 660 W 50.2 feet to a point on said San Rafael City
Limits and the easterly boundary of said Lot 128;
thence northwesterly along said City boundary to the point of
beginning.
