HomeMy WebLinkAboutCC Resolution 8314 (Temporary Homeless Shelters)RESOLUTION NO._8 314 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DENYING THE APPEAL OF THE PLANNING COMMISSION'S CONDITIONAL APPROVAL OF UP90-50, TEMPORARY HOMELESS SHELTERS LOCATED AT 1510 FIFTH AVE AND 9 ROSS VALLEY DRIVE WHEREAS, a use permit application was submitted for the establishment of a 35 bed temporary homeless shelter at 1510 Fifth Avenue and a 35 bed temporary homeless shelter at 9 Ross Valley Drive; and, WHEREAS, the Planning Commission reviewed the proposal at the regular meeting of November 27, 1990, received the planning staff report recommendation and public testimony and voted to approve said application; and, WHEREAS, the project approval was appealed to the City Council and the City Council heard the matter at a duly noticed public hearing on December 17, 1990. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council hereby denies the appeal of the Planning Commission's approval of UP90-50 based on the following findings: 1. Granting of this use permit for a 35 resident temporary weekend homeless shelter at 9 Ross Valley Drive and a 35 resident temporary weekend homeless shelter at 1510 Fifth Avenue will not be detrimental to the health, safety, or welfare of the neighborhood or the City in that the conditions of approval will adequately monitor any possible impacts to the surrounding community in that adequate staffing and security are provided; the facilities are in compliance with the standards set forth by the Fire, Police and Building Departments; adequate on-site parking is provided with regard to the proposed use as a temporary shelter. 2. The use is consistent with the goals and policies of the General Plan 2000 in that Policy H- 10 allows the conversion, construction or use of appropriately located and constructed dwellings to group quarters to meet San Rafael's share of the County's special housing needs; Policy H-32 encourages housing units for citizens with special needs; Policy LU -9 allows group care facilities in residential land use zones; and Policy H-40 encourages the providers of emergency shelters to establish an outreach program with the surrounding neighborhood. BE IT FURTHER RESOLVED that the conditions of approval attached in Exhibit "A" shall apply to UP90-50. I, JEANNE M. LEONCINI, City Clerk EXHIBIT "A" Conditions of A,yyroval Fire Department A. 9 Ross Vallev Drive. (1) A maximum capacity of 50 persons would be permitted to sleep in Turley Hall and its adjacent accessories. This is based upon the exit provisions of Uniform Building Code Chapter 33 Table 33A. (This use permit limits the numbers to a maximum of 35 people.) (2) A smoke detector which is State Fire Marshal listed and wired to the building electrical system shall be installed in the hallway leading to the sleeping room and one in the sleeping room. (3) No dead bolts, locks or latches may be installed on the exit doors which require special knowledge to use or operate. (4) Smoking is prohibited in the sleeping area. (5) Self -illuminating exit signs shall be installed above each required exit door. (6) It must be verified that the exit past the Heater Room through the stairwell is accessible to those in Turley Hall. B. 1510 Fifth Ave. (7) A maximum capacity of 35 persons would be permitted to sleep in the designated sleeping areas. This is based upon the exit provisions of Uniform Building Code Chapter 33 Table 33A. (8) A smoke detector which is State Fire Marshal listed and wired to the building electrical system shall be installed in the hallway leading to the sleeping room and one in the sleeping room. (9) No dead bolts, locks or latches may be installed on the exit doors which require special knowledge to use or operate. (10) Smoking is prohibited in the sleeping area. (11) Self -illuminating exit signs shall be installed above each required exit door. Police Department (12) The program supervisors will not be clients of the program. (13) Two private Security Officers will be at the pick-up/drop off site one hour before the pick-up time (evening) and one half hour after the drop off time (morning). (14) The behavior rules for the shelters will also apply to the clients' conduct at the pick-up / drop off site. (15) Each bus/van will have a program monitor on board. (16) The clients will be screened for acceptance by a program supervisor. A Private Security Officer will perform a secondary screening of the clients prior to admittance on the bus/van. (17) There will be a minimum of two on site program supervisors at each shelter during the waking hours. (18) During the sleeping hours each shelter will have a minimum of two on site program supervisors. (19) Two Private Security Officers will be maintained at the shelters during waking hours. During sleeping hours one security officer will rotate between the shelters. (20) Any client that leaves the shelter property, between the scheduled arrival and departure times, will be denied use of the shelter for thirty days. (21) The dates of the shelter use will be limited to the attached scheduled dates. During unexpected emergency closure of the armory, use will be limited to weekends only and only from 10 January 1991 through 27 April 1991. (This use permit limits emergency closure use to three floating weekends.) Building Department/Public Works (22) Provide smoke detectors in and adjacent to all sleeping areas. (23) All sleeping areas must have two means of egress. Planning Department (24) This use permit approves a maximum of 35 people to be housed at the First Presbyterian Church at 1510 Fifth Avenue and 35 people to be housed at the first United Methodist Church at 9 Ross Valley Drive. The temporary shelter shall be available for use during the following dates: January 11, 12 and 13; February 1, 2, and 8, 9, and 10; March 1, 2, and 15,16,17; and, April 5, 6, and 19, 20, 21, and 27. Hours of operation are to be from 7:00 p.m. to 8:00 a.m., with bus pick-up service commencing at 6:30 p.m. Additionally, the churches may be used on an emergency weekend basis between January 11 and April 27 for three additional "floating" weekends in the event that the armory is unexpectedly closed on any additional weekend dates. Seven day advance notice of this emergency use shall be required and provided to all members of the Winter Shelter Advisory Committee, the Planning Department, Police Department and the West End Neighborhood Association. (25) A mandatory review of this use permit for compliance with conditions of approval shall be scheduled for the Planning Commission meeting of February 26,1991. (26) All existing exterior lighting shall be maintained to establish a sense of well- being to the pedestrian and to facilitate recognition of persons at a reasonable distance. Type and placement of lighting shall be maintained to the satisfaction of the Police Department. (27) Parking spaces currently in existence at both shelter locations shall be maintained throughout the life of this use permit. (28) The shelter shall meet all Uniform Building Code and Uniform Housing Code standards to the satisfaction of the Building Department. The facility shall meet Uniform Fire Code requirements to the satisfaction of the Fire Marshall. (29) The shelter shall provide at least one meal to residents each day. Required permits or approvals from the County Environmental Health Department for the proposed food service or other operations associated with the use shall be actively maintained. (30) Staff services shall be provided to assist residents to obtain permanent shelter and income, and to refer to appropriate social service agencies and organizations as needed. The agency or organization operating the shelter must demonstrate familiarity with available community resources. (31) Loitering, All clients will be given a copy of the rules and regulations to read and agree to prior to admittance into the facility. Clients that are turned away shall be informed that street loitering is prohibited. If an employee notices that loitering is occurring, and the staff is unable to resolve the situation, the shelter operators shall be responsible for contacting the San Rafael Police Department. (32) No alcoholic beverages and/or other drugs and/or other medication unless prescribed by a physician shall be allowed on the property. (33) Residents who cause a peace disturbance or endanger staff or other residents shall be evicted. Readmission of evicted residents shall be based on established house rules. (34) Prior to occupancy, the provider shall establish an outreach program with the surrounding neighbors. A staff person from the provider agency shall be designated as a contact person with the community to review questions or comments from the neighborhood. (35) The provider shall maintain the program plan that contains complete house rules as shown in Exhibit "A" (attached) and shelter operation information. The house rules shall be made available to each client and consistently enforced. Any changes in the house rules are subject to the review and approval of the Planning Director and Police Department. (36) Staff levels must be maintained as follows: Three on-site supervisors during waking hours. Two on-site supervisors during sleeping hours. All the on-site staff shall be trained to provide counseling and referral services. Nursing services shall be provided one night per week at each shelter. Three volunteers shall be provided at each church between the hours of 7:00 p.m. and 9:00 p.m.. (37) Clients shall be picked up at Fourth and Heatherton Streets and bussed to the site. (38) This use permit shall be valid for five months, or until April 27, 1991, unless extended, modified, or revoked.
