RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL AMENDING RESOLUTION NO. 8185 RESCINDING
ACCEPTANCE OF CONVEYANCE OF OPEN SPACE LAND
WITHIN OAKWOOD SUBDIVISION UNIT 3
WHEREAS, a condition of approval in Oakwood Subdivision Unit 2 required
that a portion of the property be conveyed to the City as open space land; and
WHEREAS, the Subdivider, Paul Felton, has presented a grant deed of open
space to the City; and
WHERAS, on June 18, 1990, by Resolution No. 8185, the City accepted the
conveyance of open space land as described on said grant deed; and
WHEREAS, prior to recordation of said grant deed, City determined that one
of the parcels as described on said grant deed was not, in fact, vested in the grantor; and
WHERAS, said parcel will be shortly conveyed to City by the present owner,
an adjacent developer; and
WHEREAS, in order to accept the appropriate parcel at this time, it is
necessary to amend the previous resolution of acceptance by rescinding the acceptance of
that parcel not presently owned by the grantor.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
San Rafael does hereby amend Resolution No. 8185 by rescinding the acceptance of open
space land within Oakwood Subdivision Unit 3.
I, JEANNE. M. LEONCINI, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Monday, the 6th day of August, 1990, by the
following vote, to wit:
