HomeMy WebLinkAboutCC Resolution 8089 (Auto Detailing in Downtown)RESOLUTION NO.8089 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DENYING AN APPEAL OF THE PLANNING COMMISSION'S DENIAL OF A USE PERMIT TO ALLOW AUTO DETAILING IN DOWNTOWN (C-2 DISTRICT) AT 1404 SECOND STREET (UP89-3) WHEREAS, a use permit application was submitted to establish an automotive care facility at 1404 Second Street; E"] WHEREAS, the Planning Commission reviewed the proposed use and considered all reports, letters, recommendations and testimony at the regular meeting of September 12, 1989, and voted to deny the proposed use permit; and WHEREAS, the City Council of the City of San Rafael conducted a public hearing on November 6, 1989, to consider an appeal of the Planning Commission's denial of the use permit, and considered all reports, letters, recommendations, and testimony. NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of San Rafael hereby denies Use Permit 89-3 for an auto detailing business at 1404 Second Street based upon the following findings: (1) The establishment, maintenance and operation of the proposed use will under the circumstances of this particular case be detrimental to the health, safety, peace, comfort and general welfare of persons in the neighborhood as the use has the potential to create traffic hazards when vehicles back out onto the street and because there is not ample on-site parking for the proposed use. Furthermore, the proposed use is not compatible with that of the existing mix of residential and commercial uses because of the potential nuisance impacts, such as noise, odor of chemical cleaners, waxes and other car care products related to an auto detailing use. (2) The proposed use in this location cannot meet the Motor Vehicle Service Standards 14.63.010 b, e and f established by the San Rafael Zoning Ordinance because all repair work will not take place entirely within the building, ample parking cannot be provided on-site, and grandfathered parking does not allow elimination of existing spaces nor cover the increased need for additional parking. Additionally, vehicles would not be able to park so as to be headed toward the street when they exit. (3) The proposed use is not consistent with the San Rafael General Plan 2000 Policy DT -6 which requires the City to actively assist in the relocation of auto service uses in the downtown to appropriate areas within the City. Establishment of new auto service uses would be in direct conflict with the intent of this policy. RESOLUTION NO. 8089 (4) The proposed use severely limits the potential uses of other occupants and tenants of this building complex and other properties in the vicinity as there is not currently enough on-site parking for all of the uses within the building. The current Zoning Ordinance requires 16 to 18 on-site parking spaces, whereas only three spaces exist. Additionally, the proposed use is more intensive than previous uses of the buildings on site as evidenced from the parking analysis of this property. I, JEANNE M.
