RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL WAIVING FORMAL BIDDING
PROCESS FOR EMERGENCY DRAINAGE WORK BEHIND
McPHAILS, INC.
WHEREAS, the City's Storm Drainage Master Plan, currently
under preparation, defines a number of improvements necessary to the
proper functioning of the City's existing storm drainage system; and
WHEREAS, during recent rains, it was observed that there was
a significant difference in the water surface elevation at each end of
the pipelines located in an easement within the railroad right of way
behind McPhails, Inc; and
WHEREAS, in order to reduce the potential for flooding in
this area, it is extremely important that the constriction created by
the pipelines be eliminated by removing said pipelines as indicated in
the Master Plan; and
WHEREAS, because of the concern for flooding of private
properties should another storm occur, staff has engaged a contractor
to begin removal of said pipelines, necessitating the waiver of the
City's formal bid process mandated by Charter provision.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael hereby determines that the public health, welfare
and safety necessitates the waiver of the San Rafael Charter provi-
sions for competitive bidding for the emergency drainage work behind
McPhails, Inc., and directs City staff to proceed with said work with
all possible dispatch.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Tuesday, the 17th day of January, 1989, by the following vote,
to wit:
