RESOLUTION OF INTENTION TO VACATE PORTIONS OF
DRAINAGE EASEMENT; LOTS 4 AND 5, PEACOCK GAP
NEIGHBORHOOD 1-B
WHEREAS, it appears that portions of the easement hereinafter
described are unnecessary for present or prospective public use;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the City Council of the City of San Rafael,
California, hereby elects to proceed under the PUBLIC SERVICE
EASEMENTS VACATION LAW of the State of California;
2. That the City Council of the City of San Rafael,
California, hereby declares its intention to close, vacate and abandon
portions of the easement hereinafter described;
3. That Monday, the 17th day of October, 1988, at 8:00
o'clock P.M., in the Council Chambers at the City Hall in the City of
San Rafael, California, is hereby set as the time and place for hear-
ing all persons interested in the proposed closing, abandoning and
vacation of said portions of said easement;
4. That the Department of Public Works of the City of San
Rafael shall post conspicuously notices of easement vacation along the
line of the said portions of said easement proposed to be closed,
abandoned and vacated, which notices shall be posted not more than
three hundred (300) feet apart but at least three (3) notices shall be
posted as to each such easement proposed to be closed, abandoned and
vacated. The said notice shall state the time and place of the hear-
ing, as hereinabove provided, and the adoption of the within
resolution of intention;
5. That said portions of said easement proposed to be
closed, abandoned and vacated are described on Exhibit A which is
attached hereto and incorporated herein by reference;
6. That a map or plan showing said portions of said easement
proposed to be closed, abandoned and vacated is on file in the office
of the City Clerk of the City of San Rafael at the City Hall, San
Rafael, California.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Monday the 19th day of September, 1988, by the following vote,

Parcel A
Commencing at the Northwesterly corner of Lot 5 as said lot is shown on that
certain map entitled "Peacock Gap Neighborhood One -B", Marin County Records,
Marin County, California, thence on a curve to the left whose center bears
S 59-33-49 E and whose radius is 420.00 feet, through a central angle of
22-03-29 for a distance of 161.694 feet to the True Point of Beginning;
runnina thence from said point of beginning S 87-46-20 E, 126.035 feet to a
point on the Easterly boundary of the above mentioned Lot 5; thence along said
boundary of Lot 5 on a curve to the left whose center bears S 78-59-53 E and
whose radius is 295.00 feet through a central angle of 2-37-48 for a distance
of 13.541 feet; -thence leaving said Line of Lot 5, N 86-37-20 W 125.334 feet
to a point on the easterly line of Peacock: Drive; thence along said line; on a
curve to the richt whose center bears S 83-07-00 E and whose radius is 420.00
feet, through a central angle of 1-29-42 for a distance of 10,955 feet to the
point of beginning.

Commencina at the southwesterly corner of Lot 4 as said Lot is shown on that
certain map entitled "Peacock Gap Neighborhood One -B", Marin County Records,
Marin County, California, thence along the westerly line of said Lot 4 on a
curve to the richt whose renter bears N 59-20-00 E and whose radius is
420.00 feet, through a central angle of 29-28-55 for a distance of
216.114 feet to the TRUE POINT OF BEGINNING; running thence from said true
point of beginning S 87-46-20 E 125,317 feet to a point on the easterly line
of said Lot 4; thence alona the easterly line of Lots 4 and 5 on a curve to
the richt whose center bears N 87-21-59 E and whose radius is 295.00 feet,
throuah a central anale of 6-08-37 for a distance of 31.632 feet; thence
leaving said line N 86-37-20 W 125.00 feet to a point on the easterly line of
Peacock Drive, thence along said line on a curve to the left whose center
bears S 86-31-45 E and whose radius is 420.00 feet, through a central angle of
4-39-20 for a distance of 34.127 feet to the point of beginning.
