RESOLUTION DECLARING SURPLUS IN IMPROVEMENT FUND
EAST SAN RAFAEL DRAINAGE ASSESSMENT DISTRICT NO. 2
The City Council of the City of San Rafael resolves:
On June 18, 1973, the City Council adopted its Resolution
of Intention No. 4509, for public improvements in East San Rafael
Drainage Assessment District No. 2, City of San Rafael, Marin
County, California, as later amended.
Said Resolution of Intention, as later amended, provided
that any surplus in the improvement fund for said assessment, after
completion of the improvements and payment of all claims from the
improvement fund, would be applied in accordance with Section 10427
of the Streets and Highways Code of the State of California.
All improvements have been completed for which bonds have
been issued to date, and all claims upon the Improvement Fund have
been paid.
A balance of $ 63,196.09 remains in the improvement
fund for East San Rafael Drainage Assessment District No. 2, and
said amount is surplus. Said amount shall be set aside in a special
fund to be designated "Maintenance Fund, East San Rafael Drainage
Assessment District No. 2, City of San Rafael, Marin County,
California", and shall be used for the maintenance of the
improvements constructed and/or acquired in said East San Rafael
Drainage Assessment District No. 2 until said special fund is
exhausted.
I HEREBY CERTIFY that the foregoing resolution was duly and
regularly adopted by the City Council of the City of San Rafael,
Marin County, California, at a regular meeting thereof, held on the
19th day of September , 1988, by the following vote, to wit:
AYES: Councilmembers= Boro, Breiner, Frugoli, Thayer & Mayor Mulryan
NOES: Councilmembers=None
