RESOLUTION TO WAIVE FORMAL BIDDING
PROCESS FOR THE EMERGENCY RELOCATION OF
A STORM DRAIN ON GLEN PARK AVENUE AND
ROGER DRIVE
WHEREAS, in accordance with a settlement agreement between
the City and property owners in the vicinity of Glen Park Avenue and
Roger Drive, City is proposing to relocate an existing storm drain
which currently lies beneath two existing homes; and
WHEREAS, in order to complete this work prior to winter
rains, it will be necessary to waive the City's formal bid process
mandated by charter provision; and
WHEREAS, City does plan to solicit informal bids from at
least three local contractors to obtain the best possible price and to
insure an equitable distribution of City work; and
WHEREAS, because of the time constraint, City proposes to
purchase the required pipe and supply it to the contractor to save
delivery time.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael hereby determines that the public health, welfare
and safety necessitates the waiver of the San Rafael Charter provisions
for competitive bidding for the emergency relocation of a storm drain
on Glen Park Avenue and Roger Drive and directs City staff to proceed
with said relocation with all possible dispatch.
BE IT FURTHER RESOLVED that said City Council hereby
authorizes the use of $50,000 of unallocated reserves to fund said
relocation project.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said City
on Monday, the 18th day of August, 1986, by the following vote, to wit:
