RESOLUTION AUTHORIZING THE PARTIAL RELIEF
OF ASSESSMENT FOR PROPERTY OF THE
CATHOLIC ARCHDIOCESE WITHIN THE PEACOCK
GAP IMPROVEMENT DISTRICT
WHEREAS, on April 5, 1965, the City Council did accept, by
Resolution No. 3235-A, a Grant Deed from the Roman Catholic Archbishop
of San Francisco (hereinafter referred to as Archdiocese) for a 30
foot wide strip of real property for the future widening and improve-
ment of San Pedro Road. Said Grant Deed is recorded in Book 1932 at
Pages 405, 406 and 407, Marin County Official records; and
WHEREAS, the above referenced Grant Deed contained a
covenant stating that if the Archdiocese were ever assessed for the
improvement of San Pedro Road, the aforementioned right of way would
revert back to the Archdiocese; and
WHEREAS, it was the intent of the City of San Rafael to
relieve the Archdiocese of any future obligation to improve San Pedro
Road; and
WHEREAS, those lands owned by the Archdiocese described as
Assessor's Parcel No. 184-052-08 are within the limits of the Peacock
Gap Improvement District; and
WHEREAS, as a result of said Peacock Gap Improvement
District, an assessment for improvement of San Pedro Road was inadver-
tently and improperly levied against said lands owned by the
Archdiocese; and
WHEREAS, it is the responsibility of the various
properties within the Improvement District to improve San Pedro Road;
and
WHEREAS, there are sufficient funds within the Improvement
District proceeds to assume the Archdiocese's portion of the improve-
ment costs for San Pedro Road; and
WHEREAS, there are no provisions within the Improvement
District proceedings to remove the portion of the Archdiocese's as-
sessment which is attributed to the improvement of San Pedro Road; and
WHEREAS, the Marin County Auditor -Controller and Tax
Collector's offices have agreed to bill the City of San Rafael for the
portion of the Archdiocese's assessment which is attributed to the
improvement of San Pedro Road.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of San Rafael that the City of San Rafael shall agree to
pay that portion of the Archdiocese's assessment attributed to the
improvement of San Pedro Road in accordance with the attached payment
schedule labeled Exhibit "A".
BE IT FURTHER RESOLVED that the Archdiocese shall agree to
pay the remainder of their assessment levied under the Peacock Gap
Improvement District in accordance with the attached payment schedule
labeled Exhibit "B".
BE IT FURTHER RESOLVED that sufficient funds shall be set
aside from the proceeds of the Peacock Gap Improvement District to
enable the City of San Rafael to pay the assessments in accordance
with the attached payment schedule labeled Exhibit "B".
BE IT FURTHER RESOLVED that if the Archdiocese should
chose to prepay the balance of their assessment shown in Exhibit "B",
the City of San Rafael will concurrently prepay the balance of their
assessment shown in Exhibit A.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said City
on Tuesday, the 2nd day of September, 1986, by the following vote, to
wit:
