RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL DECLARING ITS INTENTION
TO ESTABLISH A NEW CITY BUSINESS IMPROVEMENT
AREA IN THE CITY OF SAN RAFAEL AND TO
DISESTABLISH THE EXISTING BUSINESS DISTRICT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of San
Rafael hereby finds, determines, and declares as follows:
(a) Pursuant to Section 36500 et seq. of the
Streets and Highway Code of the State of California,
the City Council hereby declares its intention to
consider the creation of a Business Improvement Area
(hereafter "Area");
(b) That it is proposed to include all of the
real property within the boundaries as described on
Exhibit "A", attached hereto and incorporated herein
by this reference; and
(c) That a public hearing concerning the
formation of said proposed Area will be held on
Monday, April 7, 1986, at 8:00 P.M., or as soon
thereafter as the matter can be heard, in the City
of San Rafael located at 1400 Fifth Avenue, San
Rafael, California; and
(d) A description of the proposed system of
charges is set forth on Exhibit "B", attached hereto
and incorporated herein by this reference; and
(e) The proposed uses of the revenues derived
from charges imposed in such Area are as follows:
(1) decoration of any public place in
area;
(2) promotion of public events which
are to take place on or in the area;
(3) furnishing of music in any public
place in the area; and
(4) the general promotion of business
activities in the area.
SECTION 2. That if the Business Improvement Area
described in SECTION 1 is formed, effective that same date the
Business Improvement District created under Ordinance No. 1435
adopted on July 19, 1982 shall be disestablished.
SECTION 3. That the City Clerk shall certify the
adoption of this Resolution, cause the same to be published in
the manner prescribed by law, and shall mail a complete copy of
this Resolution to each person owning or operating a business
which is located in the proposed area described on Exhibit "A".

California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 17th day of March, 1986, by the
following vote, to wit:

EXHIBIT "A"
BUSINESS IMPROVEMENT AREA
That Portion of the City of San Rafael, County of Marin, State of
California, bounded and described as follows:
Beginning at the southern side of Third Street where
Third Street intersects the centerline of Union Street,
and continuing along the centerline of Union Street in a
northerly direction to the point on the centerline of
Union Street 100 feet North of the northern side of
Mission Street where Mission Street intersects the
centerline of Union Street, thence in a westerly
direction along a line 100 feet North of the northern
side of Mission Street to a point on the Western side of
H Street 100 feet North of the northern side of Mission
Street, thence along a straight line to a point on the
South side of Harcourt Street 100 feet West of the
intersection of Harcourt Street and H Street, thence in
a southerly direction along a line 100 feet West of the
western side of H Street to a point which is 100 feet
North of the northern side of Fourth Street, thence in a
westelry direction along a line 100 feet North of the
northern side of Fourth Street to a point which is due
North of the point that is 50 feet West of the eastern
point of the intersection of Fourth Street and Second
Street, thence in a southerly direction along a line
which is 50 feet West of the eastern point of the
intersection of Fourth Street and Second Street to a
point which is 100 feet South of the southern side of
Second Street, thence in an easterly direction along a
line 100 feet South of the southern side of Second
Street to a point 100 feet South of the centerline of
Hayes Street where it intersects the southern side of
Second Street, thence in an easterly direction along a
line which is 50 feet South of the southern side of
First Street to a point on the western side of B Street
which is 50 feet South of the point where the southern
side of First Street intersects B Street, thence in an
easterly direction along a straight line which ends at a
point on the Northwestern Pacific Railroad Right of Way
which is directly South of the centerline of Brooks
Street where Brooks Street intersects the northern side
of Second Street, thence in an easterly direction along
the Northwestern Pacific Railroad Right of Way to a
point East of Lindaro Street where that Right of Way
intersects another Northwestern Pacific Railroad Right
of Way which curves in a northeasterly then easterly
direction, thence along said Right of Way which curves
in a northeasterly then easterly direction to a point
where said Right of Way intersects the centerline of

Irwin Street, thence in an easterly direction along a
line across Highway 101 to a point which is the
Southwest corner of Grand Avenue, thence along the
Western side of Grand Avenue to a point where the
Western side of Grand Avenue intersects the Northern
side of the San Rafael Canal, thence along the Northern
side of the San Rafael Canal to the San Rafael Pump
Station at the Southeast corner of the property
presently known as Montecito Shopping Center, thence in
a northerly direction along the Eastern boundary of said
Montecito Shopping Center to the point where said
boundary intersects the Southern side of Third Street,
thence in a westerly direction along the Southern side
of Third Street to the point of beginning.
ZONE 1 BOUNDARY
That portion of the aforedescribed Business Improvement Area:
which lies East of a straight line running from the
Northern to Southern boundaries of the Area, which
line is parallel to and 100 feet West of the Western
side of E Street; and which lies West of a line that
commences on the Northern boundary of the District and
runs South along the Northwestern Pacific Railroad Right
of Way that parallels Tamalpais Avenue to the point
where that Right of Way starts curving to the East,
thence due South to the San Rafael Canal, and thence to
the West and South along the San Rafael Canal to the
point where said Canal intersects the Southern boundary
of the Area near Lindaro Street.
ZONE 2 BOUNDARY
That portion of the aforedescribed Business Improvement Area
which is not in Zone 1 as hereinabove described.

EXHIBIT "B"
ANNUAL CHARGES TO BUSINESSES LOCATED IN THE BUSINESS
IMPROVEMENT AREA SHALL BE AS FOLLOWS
The district has been divided into two zones of benefit.
Zone 1 is the area of primary benefit and Zone 2 is the area of
secondary benefit. The Zones are described in EXHIBIT "A".
Businesses within the boundaries of the Area have been
classified as Professional, Service, Financial, Wholesale and
Manufacturing, Retail and Specific Business.
Professional
Businesses classified as Professional shall be those
identified under classification numbers 700-799, City of San
Rafael 1985 License Fee Schedule.
Service
Businesses classified as Service shall be those identified
under classification numbers 600-699, City of San Rafael
1985 License Fee Schedule.
Financial
Businesses classified as Financial include, but are not
limited to, Banks, Savings & Loans, Credit unions.
Wholesale and Manufacturing
Businesses classified as Wholesale and Manufacturing shall
be those identified under classification numbers 540, 562,
563 and 580, City of San Rafael 1985 License Fee Schedule.
Retail
Businesses classified as Retail shall be those identified
under classification numbers 500-599, City of San Rafael
1985 License Fee Schedule, excluding nos. 540, 562, 563 and
580.
Specific Businesses
Specific Businesses include Ambulance Service, Apartments,
Arcades, Boarding/Rooming House, Bowling Alley/Pool,
Hospital, Hotel, Auto Court, Mini Warehouse, Mobil Home
Park, Movie Theatre, Parking Lot, Public Card Tables,
Taxicab, Undertaker/Mortuary, Veterinary.

Assessment Formula, Zone 1
Businesses classified as Professional shall pay an annual assess-
ment equal to One Times (i X) their annual Business License Fee.
Businesses classified as Service shall pay an annual assessment
equal to One Times (1 X) their annual Business License Fee.
Businesses classified as Financial shall pay an annual assessment
of Two Hundred Fifty ($250.00) Dollars.
Businesses classified as Wholesale and Manufacturing shall pay an
annual assessment equal to One Times (1 X) their annual Business
Business License Fee.
Businesses classified as Retail shall pay an annual assessment
equal to Three Times (3 X) their Annual Business License Fee.
Specific Businesses, See Below.
Zone 2
Businesses classified as Professional shall pay an annual assess-
ment equal to One Half (1/2) their annual Business License Fee.
Businesses classified as Service shall pay an annual assessment
equal to One Half (1/2) their annual Business License Fee.
Businesses classified as Financial shall pay an annual assessment
of Two Hundred ($200.00) Dollars.
Businesses classified as Wholesale and Manufacturing shall pay an
annual assessment equal to One Half (1/2) their annual Business
License Fee.
Businesses classified as Retail shall pay an annual assessment
equal to One and One Half Times (1-1/2 X) their annual Business
License Fee.

Specific Businesses in Zone 2 will be assessed at One Half (1/2)
of the annual assessment rate for Specific Businesses in Zone 1.
The assessment formula is based on the 1985 License Fee Schedule
of the City of San Rafael and cannot be changed without proper
notice to all businesses in the area and a public hearing held by
the City Council. Chznges in the Business License Ordinance or
License Fee Schedule after 1985 will not change the rate of
assessment on businesses in the Management -Promotion area.
