A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL ACCEPTING GRANT OF
EASEMENT FOR PUBLIC INGRESS AND EGRESS ON
PRIVATE SIDEWALK (899 NORTHGATE DRIVE).
WHEREAS, public interest, convenience and welfare require
that the easement hereinafter mentioned be accepted and used for the
benefit of the public of the City of San Rafael, California;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of San Rafael, California, that that certain grant of
easement for public ingress and egress on private sidewalk at 899
Northgate Drive, executed by HBC One, Ltd. to the City of San Rafael,
dated December 7, 1984, be and the same is hereby accepted and the
Clerk of said City is hereby directed to cause said conveyance to be
duly recorded in the office of the County Recorder of the County of
Marin, State of California, forthwith upon the adoption of this
resolution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the Council of
said City held on the 21st day of April, 1986, by the following vote,
to wit:

GRANT OF EASEMENT FOR PUBLIC INGRESS
AND EGRESS ON PRIVATE SIDEWALK
HBC ONE, LTD (hereinafter
called "Grantor' without regard to number or gender) for an adequate consideration
hereby GRANT$ and conveys to the CITY OF SAN RAFAEL, a municipal corporation, an
EASEMENT over the strip of land hereinafter described for the purpose of public
ingress and egress on a private sidewalk in, -on and across said
strip of land and the contiguous real property of Grantor.
Said strip of land is located in the City of San Rafael, County of Marin,
State of California, and is more particularly described a5 follows:
(SEE ATTACHED)
Grantor shall not plant, place or deposit anything in or on said strip of
land which will damage or interfere with any of the rights granted hereunder nor
shall Grantor erect or construct any building or other structure or drill or
operate any well within said strip of land.
The provisions hereof shall inure to the benefit of and bind the heirs,
successors, and assigns of the respective parties hereto.

Description of Sidewalk Easement
Along Northgate Drive

An easement for a public sidewalk and for public ingress and
egress over said sidewalk over that certain real property
situate in the City of San Rafael, County of Marin, State of
California, described as follows:
A strip of land 2 feet in width over a portion of Lot 2 as
said Lot is shown on that certain Map entitled "Map of Quail
Hill, San Rafael, California", recorded May 24, 1972 in Volume
15 of Maps at page 22, Marin County Records, more particularly
described as follows:
BEGINNING at the Southeasterly corner of the hereinabove
described Lot 2; thence along the Southerly line of said Lot 2
North 550 40' 00" West 2.24 feet; thence leaving said
Southerly line along the arc of a curve to the left from a
tangent which bears North 070 22' 11" East having a radius
of 1238.00 feet through a central angle of 140 22' 1111, an
arc distance of 310.49 feet; thence North 070 00' 00" West
16.49 feet to a point in a curve to the South and East having
a radial bearing of North 280 02' 22" West and a radius
length of 30.00 feet through a central angle of 210 02' 2211,
an arc length of 11.02 feet; thence tangent to the preceding
curve and along the Easterly line of the hereinabove described
Lot 2 South 070 00' 00" East 5.72 feet; thence along the arc
of a tangent curve to the right having a radius of 1240.00
feet through a central angle of 140 25' 0011, an arc length
of 312.00 feet to the point of beginning and terminus of this
description containing 648 square feet, more or less.
