Home My WebLink AboutCC Resolution 7118 (Coleman's Spring Lot)RESOLUTION NO. 7118 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE MAYOR TO ACCEPT A QUITCLAIM RELINQUISHING EASEMENT RIGHTS FOR ONE OF TWO PRIVATELY OWNED PARCELS KNOWN AS "COLEMAN'S SPRING LOT" TO CITY OPEN SPACE WHEREAS, California Government Code Section 27281 requires that deeds or grants conveying any interest in, or easement upon, real estate to a political corporation or governmental agency for public purposes shall not be accepted for recordation without the consent of the grantee evidenced by its certificate or resolution of acceptance attached to or printed on the deed or grant; and WHEREAS, Section 27281 also states that a political corporation or governmental agency, by a general resolution, may authorize an officer or agent to accept and consent to such deeds or grants; and WHEREAS, on September 4, 1984, the City Council accepted a grant deed for dedication of "Coleman's Spring Lot" (AP 15-250-03) to the City of San Rafael. The grantor reserved an exclusive perpetual easement for the use and enjoyment of spring, tunnel and waters of the spring and pipeline. The easement was granted to Parcels A and B indicated on City approved parcel map s83-10; and WHEREAS, the property owners of Parcel B request that the City accept a quitclaim relinquishing their easement rights to the City open space. The easement rights to Parcel A would remain unchanged. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of San Rafael, California, does hereby authorize the Mayor of City of San Rafael to accept a quitclaim relinquishing easement rights to City open space known as "Coleman's Spring Lot" (AP 15-250-03) and consent to the recordation thereof. 01"AILGINAL7W RESOLUTION NO. 7118 I, JEANNE M.
