ORDINANCE NO. 1595
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING
TITLE 3, CHAPTER 3.22, SECTION 3.22.020 OF THE MUNICIPAL
CODE TO INCREASE THE PROPERTY TRANSFER TAX
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Title 3, Chapter 3.22, Section 3.22.020 of
the San Rafael Municipal Code is hereby amended and shall read as
follows:
3.22.020 Imposition. There is imposed on each deed,
instrument, or writing by which any lands, tenements, or other
realty sold within the City shall be granted, assigned,
transferred, or otherwise conveyed to, or vested in, the purchaser
or purchasers, or any other person or persons, by his or their
direction, when the consideration or value of the interest or
property conveyed (exclusive of the value of any lien or
encumbrances remaining thereon at the time of sale) exceeds one
hundred dollars ($100), a tax at the rate of two dollars ($2.00)
for each one thousand dollars ($1,000) of the value of
consideration or fractional part thereof.
DIVISION 2. If any section, subsection, sentence,
clause, or phrase of this ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the
remaining portions of this ordinance. The Council hereby declares
that it would have adopted the ordinance and each section,
subsection, sentence, clause, or phrase thereof, irrespective of
the fact that any one or more sections, subsections, sentences,
clauses, or phrases be declared invalid.
DIVISION 3. This ordinance shall be published once in
full before its final passage in a newspaper of general
circulation, published and circulated in the City of San Rafael,
and shall be in full force and effect thirty (30) days after its
final passage.

introduced at a Reqular meeting of the City Council of the
City of San Rafael, held on the 17th day of September
1990, and ordered passed to print by the following vote, to wit:

NOES COUNCILMEMBERS: Shippey
ABSENT: COUNCILMEMBERS: Mayor Mulryan
