RESOLUTION APPROVING AGREEMENT FOR
LANDSCAPE ARCHITECTURAL SERVICES
KERNER BOULEVARD ASSESSMENT DISTRICT
The City Council of the City of San Rafael resolves:
As a part of the proceedings for improvements in the
Kerner Boulevard Assessment Distrrict, this Council approves that
certain agreement between the City of San Rafael and SPEER AND
ASSOCIATES for landscape architectural services, dated March 19,
1984, and attached to this resolution.
The Mayor is authorized to sign the agreement and the City
Clerk is authorized to attest its execution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 19th day of March, 1984, by the
following vote, to wit:

AGREEMENT FOR LANDSCAPE ARCHITECTURAL SERVICES
Kerner Boulevard Assessment District, City of San Rafael, Marin
County, California
This is an agreement for landscape architectural services
between the CITY OF SAN RAFAEL, a municipal corporation of the State
of California, referred to as Client, and SPEER AND ASSOCIATES, referred
to as Landscape Architect.
I. Client retains Landscape Architect for the Kerner
Boulevard Assessment District, City of San Rafael, Marin County, Calif-
ornia, to perform the following services:
a. Preparation of preliminary plans and designs.
b. Review of sketches with B.C.D.C., Audubon Society, planning
staff, etc. Obtain approvals.
C. Meet with MMWD and other agencies to promote the access ease-
ment concept, for the shoreline access.
d. Prepare a layout plan showing horizontal locations of all
landscape items.
e. Prepare an irrigation plan, installation details and written
specifications.
f. Prepare a planting plan, installation details and written
specifications.
g. Prepare soil preparation and finished grading written speci-
fications.
h. Conduct marsh planting research and utilization of technical
consultants.
i. Prepare a drip irrigation plan, details and specifications
for mitigation pond landscape.
j. Prepare an erosion and sediment control plan with details and
specifications. Consult with civil engineer.

k. Interface wi-th all appropriate agencies, review plans, and
obtain necessary approvals. Attend planning and City Council
meetings of Client as necessary. Meet with contractors to
plan schedules, etc.
1. Provide the following construction details and correspond-
ing written specifications:
- All necessary signage and identification of parking or
access path;
- Removeable bollards.
Seating.
Special pavement and handicap ramp.
Fencing required along shoreline access, west of
MMWD property. (Approximately 260 l.f.)
- Asphalt or A.C. pathway, or shoreline park access.
M. Prepare bid packages and construction documents and
obtain and review bids. Coordinate with project manager.
n. Provide 26 on-site construction observations with written
reports documenting compliance and/or progress of work.
II. In consideration of the services set forth in paragraph I,
Client shall pay to Landscape Architect the sum of $11,300.00, pay-
able as follows:
Fifty percent (50%) of said fee shall be due and payable
upon receipt of bond proceeds.
The remaining fifty percent (50%) shall be due and payable
as billed monthly during the course of construction of the
landscaping improvements.
Payment by Client of the landscape architectural fee is con-
tingent upon the levy of assessments and the sale and delivery of
improvement bonds representing unpaid assessments in the assessment

district. If for any reason assessments are not confirmed and bonds
delivered, Landscape Architect shall be paid no landscape architec-
tural fee.
