RESOLUTION NO. 6832
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ADOPTING THE 1984 RECREATION ELEMENT
OF THE GENERAL PLAN WHICH REPLACES THE RECREATION
PARK PLAN ELEMENT ADOPTED AUGUST 16, 1976
WHEREAS, Section 65303(a) of the Government Code allows
cities to include Recreation Elements showing a comprehensive
system of areas and public sites for recreation as part of their
General Plans; and
WHEREAS, a city cannot require land dedication for
recreation purposes under Section 66477 of the Government Code un-
less the City has an adopted Recreation Element containing definite
standards; or purchase school recreational facilities at a reduced
cost under Section 39397.5 of the Education Code unless the City
has a plan for such potential purchase; and
WHEREAS, the City must have an adopted bicycle route plan
in order to qualify for most State and Federal bicycle route funds;
and
WHEREAS, the proposed Recreation Element contains the
necessary plans required by the above legislation, as well as
provides a plan for maintenance and enhancement of City park and
recreation facilities; and
WHEREAS, an August 1983 Draft Recreation Element was
widely distributed for review and comment to all homeowners
associations, public agencies and other interested persons and
groups, and the Planning Commission and Parks and Recreation
Commission established a recreation subcommittee to review and
make modifications to the draft; and modifications made as a
result of the recreation subcommittee review and as a result of
written comments received were incorporated into a revised January
1984 Draft Recreation Element, which was again distributed to all
interested parties; and
WHEREAS, the Planning Commission and Parks and Recreation
Commission held an advertised joint public hearing on January 31,
1984, at which time written and verbal testimony are considered;
and

WHEREAS, on January 31, 1984, the Planning Commission
and Parks and Recreation Commission recommended to the City
Council certification of an environmental assessment which con-
cluded that all environmental effects discussed were found not to
be significant and adoption of the draft Recreation Element with
minor modifications; and
WHEREAS, the City Council held a duly advertised public
hearing on May 21, 1984, when written and verbal comments were
considered, the Negative Declaration for the Recreation Element
was certified and certain modifications to the Element were
requested prior to adoption; and
WHEREAS, on June 4, 1984, the City Council reviewed all
materials prepared by staff at Council's direction on May 21,
1984, regarding revisions to the draft Recreation Element.
NOW, THEREFORE, BE IT RESOLVED that the City Council
finds that:
1. The Recreation Element as revised responds to
recreation needs and issues in San Rafael and provides a plan for
future development of recreation facilities; and
2. The Recreation Element provides plans adequate to
comply with Education Code Section 39397.5, and Government Code
Sections 66477, and 65303(a), the State law sections pertaining to
recreation elements.
BE IT FURTHER RESOLVED that the City Council adopts
the 1984 Recreation Element, as revised consistent with the
Council's recommendations, to replace the 1976 Recreation Park
Plan Element of the General Plan.
