A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL OF INTENT TO ACCEPT THE GROVE HILL
"POCKET PARK" AS A PUBLIC FACILITY
WHEREAS, on May 17, 1982, the City approved master plan
zoning and a tentative subdivision map for the Grove Hill project
located on the south side of Fifth Avenue in between "K" Street
and Racquet Club Drive in Sun Valley; and
WHEREAS, as part of that project the applicant proposed
development of a 6,000 square foot "pocket park" located on Fifth
Avenue for dedication to the City as a public park; and
WHEREAS, condition (p)3 of the tentative subdivision
indicates that the developer is responsible for preparing a
landscape plan and installing landscape improvements for the pocket
park prior to an offer of dedication on the final map; and
WHEREAS, condition (p)3 of the subdivision approval
further indicates that if the park is not accepted as a public
facility by the City Council the area shall be designated as part of
the common open space with an easement for public use; and
WHEREAS, in order to prepare required CC&Rs and Department
of Real Estate documentation, the developer has requested that the
City Council indicate their intent regarding acceptance of the park
as a public facility; and
WHEREAS, the developer has prepared a landscape plan which
includes the recommendations of the City's Design Review Board, the
Parks and Recreation Department and the neighborhood; and
WHEREAS, the adopted Recreation Element of the San Rafael
General Plan denotes the 6,000 square foot Grove Hill pocket park
as a public facility and entranceway to the trail system.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City
Council hereby states their intent to accept said pocket park as a
public facility at the time of final map approval and contingent
upon installation of improvements as required under the tentative
subdivision approval.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on MONDAY , the 16TH day of JULY 1984, by the
