RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL DETERMINING THE PUBLIC INTEREST AND
NECESSITY REQUIRE ACQUISITION OF STREET LIGHT
FACILITIES IN THE INCORPORATED AREA OF THE CITY
OF SAN RAFAEL, APPROVAL OF PLANNING AND NECESSITY
OF SAID ACQUISITION.
WHEREAS, the City Council has heretofore considered the
advisability of acquisition of street light facilities claimed by
Pacific Gas & Electric Co.;and
WHEREAS, the City Council through its representatives has
participated in discussions with other jurisdictions in the County
discussing the feasibility and procedure for such acquisition; and
WHEREAS, the City Council has authorized discussions be-
tween its representatives and representatives of PG&E for acquisition
of such facilities without the necessity of litigation; and
WHEREAS, PG&E has failed to meaningfully discuss such
acquisition; and
WHEREAS, the City Council has heretofore caused notice,
pursuant to the Code of Civil Procedure, to be mailed to Pacific Gas
& Electric Co., giving them an opportunity to appear and be heard on
the issue of acquisition of street lighting facilities by the County;
and
WHEREAS, the City Council has heretofore considered all
points of view presented to it with respect to acquisition of street
lighting facilities;
NOW, THEREFORE, it is hereby found and resolved by the City
Council as follows:
1. The public use for which the property described herein is
required is that of a lighting system for the City of San Rafael
acquisition of which street lighting facilities is authorized by
Government Code Section 25350.5.
2. The property to be acquired and its general location is des-
cribed in Exhibit A, said Exhibit A is on file in the Public Works
Department and by this reference is incorporated herein.

3. This Council has found and determined that it is necessary
for the City of San Rafael to acquire the property described herein
for the reason that it now has no lighting system of its own but
has been and now is dependent on private corporations to furnish it
with light for its streets, public places and parks by contract, and
the project of acquiring said facilities is in the public interest.
The acquisition is planned in the manner that will be most
compatible with the greatest public good and the least private injury
and is clearly necessary for the City's planned project of acquisi-
tion of said street lights.
