A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL RECOMMENDING TO THE MARIN LOCAL AGENCY
FORMATION DISTRICT (LAFCo) THE APPROVAL OF AN
EXCEPTION TO WAIVE THE DUAL ANNEXATION POLICY FOR
ANNEXATION REQUESTS TO THE SAN RAFAEL SANITATION
DISTRICT AT 1, 5 & 7 MORGAN LANE
WHEREAS, the Marin Local Agency Formation District has
received one proposal in unincorporated Country Club for annex-
ation to the San Rafael Sanitation District; and
WHEREAS, consistent with LAFCo policies, the proposal
was referred to the City of San Rafael for review and comment;
WHEREAS, on September 25, 1984, the Planning Commission
reviewed this referral and received public testimony. The Planning
Commission determined that there are special circumstances
surrounding the properties in question that warrant approval
of an exception to waive the dual annexation policy; and
WHEREAS, on October 1, 1984, the City Councy reviewed
the proposal concurring with the Planning Commission findings.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council recommends that the Marin Local Agency Formation
District approve an exception to waive the dual annexation policy
for annexation to the San Rafael Sanitation District at 1, 5 & 7
Morgan Lane (Morgan Lane Annexation) based on the following findings:
There are special and unusual circumstances
surrounding the properties in question that
warrant approval of an exception to waive
the dual annexation policy. The current
septic tanks serving these properties have
the potential to create health problems to
adjacent properties. Additionally, the
slope of the properties is such that the
most reasonable sewer connection to the

San Rafael Sanitation District will be
through the Villa Real neighborhood, and
that this will not change if annexation
to the San Rafael Sanitation District occurs
now or in the future (when, or if, Country
Club annexation occurs).

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Monday , the lst day of October , 1984, by the
following vote, to wit:
