HomeMy WebLinkAboutCC Resolution 6975 (Spinnaker on the Bay Project)RESOLUTION NO.6975 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL CERTIFYING THE FINAL EIR FOR THE SPINNAKER ON THE BAY PROJECT, BELLAM AT CATALINA BOULEVARDS WHEREAS, in September 1982, a zone change application was filed for development on the subject property; and WHEREAS, in April 1983, the Planning Commission found that the project could potentially impact the environment and directed staff to prepare an Environmental Impact Report focusing on a number of specific items; and WHEREAS, after consultation with various responsible and trustee agencies and interested organizations, a draft EIR was prepared and completed in April 1984; and WHEREAS, pursuant to the California Environmental Quality Act, the draft EIR was circulated for a 45 day public review period, ending June 4, 1984; and WHEREAS, all comments received on the document were responded to, forming the Final EIR; and WHEREAS, on August 28, 1984, the Planning Commission reviewed the Final EIR, discussed the document but continued action pending input regarding on-site mitigation for the Salt Marsh Harvest Mouse; and WHEREAS, on October 9, 1984, the Planning Commission reviewed the Final EIR with an Addendum recommending to the City Council that the document be certified; and WHEREAS, on November 19, 1984, the City Council reviewed the Final EIR with Addendum making the following findings: 1. The Environmental Impact Report has been prepared in accordance with the California Environmental Quality Act. The necessary procedure requirements for processing an EIR have been completed. A Notice of Prepar- ation outlining the scope of the EIR docu- ment was distributed for public review in September 1983. Consultation and public hearings have been held to determine the scope of potential environmental impacts. The draft EIR was circulated for a 45 day public review period from April 16, 1984, to June 4, 1984. All oral and written comments have been responded to and included in the Final EIR document. RESOLUTION NO. 6�•.i 2. The content of the Final EIR is consistent with the California Environmental Quality Act. The EIR adddresses those environmental issues that were addressed as part of con- sultations and a public hearing on the initial study. Those areas of focus were: geology/soils, hydrology/drainage, water quality/aquatic biology, biological resources, traffic/air quality and noise, recreation/ open space, public services, housing, cumu- lative impacts, and project alternatives. The EIR identifies the potential environ- mental impacts of the proposed project, mitigation measures, and alternatives. 3. The EIR concludes that there would be a number of unavoidable adverse impacts associated with the proposed project that could be mitigated through project redesign. Unavoidable adverse impacts include the permanent loss of lagoon and wetland areas which provide valuable wildlife habitat, the decrease in water quality and aquatic biology into the lagoon, an increase in the amount of mosquito complaints in the area, and an increase in traffic which would result in the operation of the Bellam intersections at Level of Service "F", even with interim intersection improvements. The EIR iden- tifies "no fill" alternatives that could reduce unavoidable adverse impacts to acceptable levels. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council certifies the Final EIR and Addendum prepared for the Spinnaker on the Bay project. I, JEANNE M.
