RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL ACCEPTING CONVEYANCE
OF REAL PROPERTY - PEACOCK MANOR PARK SITE,
SAN RAFAEL, CALIFORNIA
WHEREAS, the public interest, convenience, necessity and
welfare require that the real property hereinafter mentioned be
accepted and used as park lands for the benefit of the public of
the City of San Rafael, California;
WHEREAS, it is the intent of the City Council to reimburse
the San Rafael School District for the dedication of this park land,
at some future date, through bond proceeds of the Peacock Gap Improve-
ment District;
WHEREAS, it is the intent of the City Council to amend the
Peacock Gap Improvement District proceedings, at some future date, to
provide for said reimbursement to the San Rafael School District;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael, California, does hereby accept that certain deed
for and on behalf of the City of San Rafael and the real property
described therein, all as more particularly described and set forth
in the attachment hereto and incorporated herein by reference, and said
deed is to be duly recorded in the Office of the County Recorder of the
County of Marin, State of California, forthwith upon the adoption of
this resolution and close of escrow.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the Council
of said City held on the 3rd day of December, 1984, by the following
vote, to wit:

LEGAL DESCRIPTION
CITY PARK ACQUISITION FROM THE
SAN RAFAEL SCHOOL DISTRICT
Commencing from a point, said point being the intersection of the
centerlines of Biscayne Drive and Riviera Drive, shown as an existing
standard street monument on the map entitled "Map of Marin Bay Unit
One" recorded September 22, 1960, in Volume 10 of Maps at page 78, at
the Office of the Recorder, Marin County, California. Thence from said
point of Commencement along the centerline of Riviera Drive South 18°
33' 50" West 106.68 feet to another existing street monument as shown
on said map, thence South 71° 26' 10" East 30.00 feet to a point on the
Easterly right-of-way line of Riviera Drive, thence Southerly along
said right-of-way line, along a curve, concave to the East whose
center bears South 710 26' 10" East, having a radius of 970.00 feet,
through a central angle of 3° 30' 05" a distance of 59.28 feet to the
True Point of beginning of this description; thence continuing along
said right-of-way, from said True Point, along a tangent curve, concave
to the East having a radius of 970.00 feet, through a central angle of
2° 30' 44" a distance of 42.53 feet, thence leaving said right-of-way;
along a tangent curve, concave to the NE having a radius of 30.00
feet, through a central angle of 970 58' 01" a distance of 51.30 feet,
thence South 85° 25' 00" East 82.71 feet, thence North 4° 35' 00" East
116.94 feet, thence South 89° 10' 00" West 66.03 feet, thence along a
curve, concave to the NW whose center bears North 38° 54' 02" West,
having a radius of 50.00 feet, through a central angle of 26° 00' 09" a
distance of 22.69 feet to a point of reverse curvature, thence along
said reverse curve, having a radius of 30.00 feet, through a central
angle of 62° 02' 22" a distance of 32.48 feet to the True Point of
Beginning, containing 0.2659 acres, more or less.
