SUBJECT: ACCEPT COMPLETION OF THE 7 BEECHWOOD COURT STORM DRAIN IMPROVEMENTS
PROJECT (CITY PROJECT NO. 11305), AND AUTHORIZE THE CITY CLERK TO FILE THE
NOTICE OF COMPLETION.
RECOMMENDATION: Accept completion of the project and authorize the City Clerk to file the Notice of
Completion.
BACKGROUND: The City maintains a storm drain easement near #7 Beechwood, which was accepted by
the City in the 1960’s. A 5-foot diameter corrugated metal pipe (CMP) exists underneath an 80-foot
section of the easement. The original corrugated metal pipe had deteriorated over time to a point at
which the adjacent properties were being damaged by a growing sinkhole caused by the deteriorated
CMP within the culvert.
City Staff prepared an engineering plan to replace the corrugated metal pipe in the backyard of #7
Beechwood Court with high density polyethylene pipe (HDPE). High density polyethylene pipe (HDPE) is
a longer lasting alternative to CMP and is preferred for installation in locations like this. On May 15,
2017 City Council authorized the City Manager to execute the agreement with Wildcat Construction to
construct the project.
Public Works worked closely with the property owner at #7 Beechwood throughout the construction as
well as other property owners in the area. The construction area and easement for access was very
narrow which presented considerable constructability challenges in bringing in a large culvert and
installing the pipe. The creek bank and construction area was re-landscaped following the installation of
the culvert.
ANALYSIS: Pursuant to Civil Code Section 3093, the City is required to record a Notice of Completion
upon City acceptance of the improvements. This acceptance initiates a time period during which project
subcontractors may file Stop Notices seeking payment from the City from the funds owed to the
Contractor for the project work.
