HomeMy WebLinkAboutResolution No. 6666 (Child Care Programs Lease)RESOLUTION NO. 6666 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a contract, lease or agreements with SAN RAFAEL SCHOOL DISTRICT RE: USAGE OF SHORT, BAHIA VISTA, GLENWOOD AND GALLINAS ELEMENTARY SCHOOLS FOR CHILD CARE PROGRAMS a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINT,, CITY CLERK IT _.._ Lo LEASE AGREEMENT SHORT SCHOOL THIS AGREEMENT, entered into this seventh day of November 1983 by and between the City of San Rafael, hereinafter referred to as "CITY" and the San Rafael School District, hereinafter referred to as "DISTRICT". WITNESSETH WHEREAS, District is the owner of that certain real property known as SHORT SCHOOL; and WHEREAS, said SHORT SCHOOL is not now, and will not be during the term of this Agreement, needed for school classroom buildings by District; and _ WHEREAS, the City is desirous of leasing a portion of SHORT SCHOOL for certain functions provided by the City of San Rafael Recreation Department; and WHEREAS, Education Code Sections 39500, et. seq., provides that a school district may lease school property not needed for classroom use to another governmental agency. NOW, THEREFORE, BE IT HEREBY AGREED AS FOLLOWS: 1. District leases to the City, and the City leases from the District, portions of that property known as SHORT SCHOOL (see attachment) for a period commencing September 9, 1983 through June 30, 1986 for the consideration shown in the schedule below: CITY leases 9,388 square feet Amount to be paid by City, per square foot, per month: September 1, 1983 -June 30, 1984 20� per sa. ft. July 1, 1984 -June 30, 1985 21� per sq. ft. July 1, 1985 -June 30, 1986 22� per sq. ft. Payable in quarterly installments no later than the eighth (8th) calendar day after the start of the Lease; and, at the beginning of each quarterly period thereafter. 2. It shall be the obligation of the City to pay costs of water, electricity, gas, alarms, garbage pick-up and minor maintenance and grounds care. If portions of the site are rented by the school district to other tenants, the other tenants will be required to pay a pro -rated share of these costs based on the amount of square feet leased. Other tenants will be billed by the City for these costs. 3. District is responsible for major maintenance of the plant, including roofs, asphalt surfaces, heating and air conditioning and major plumbing repairs. 4. District shall maintain, in force, the existing fire and extended coverage insurance on the buildings. 5. It shall be the responsibility of the City to maintain in force during the term of this Agreement, public liability insurance, naming District as an additional insured. It shall further be the responsibility of the City to maintain appropriate insurance on the contents of the buildings. District shall indemnify and hold the City harmless from any liability for personal injury or property damage arising out of structural defects or the District's negligence in its maintenance. 6. The City shall not make structural -alterations without first receiving written permission from District. 7. The City shall not sub -lease or assign the use of any portion of the leased premises without the written approval of the District Admin. 8. This Agreement may be amended or terminated by the mutual consent of the parties hereto and may be cancelled by either party upon ninety (90) days' notice. Mvfn THAT Q WHEREAS, City and District are mutually agreeable to an agreement allowing City to use one (1) Portable Classroom, of approximately 900 square feet, located at: BAHIA VISTA ELEMENTARY SCHOOL, 125 Bahia Way, San Rafael, California, 94901 from 1983/83-1985/86 school year, starting on July 1, 1983 and ending on June 30, 1986, for the sum of TWO HUNDRED DOLLARS ($200.00) per month. WITNESSETH FOR AND IN consideration of mutual promises, covenants and conditions hereinafter contained, the parties hereto agree as follows: 1) City is hereby granted by District, the right to use one (1) portable Classroom at BAHIA VISTA SCHOOL for the purpose of providing a Child Care Program. 2) District will furnish utilities and maintenance. 3) District agrees to give City a minimum of 30 days' notice if District wishes to move program to another school or classroom. 4) City agrees to pay a monthly rental charge of $200.00 per month, payable on the first day of each calendar month. 5) City shall indemnify and hold District harmless from any liability for personal injury or property damage arising out of the use of District facilities by City pursuant -to this Agreement. 6) This Agreement may be amended or terminated by the mutual consent of the parties hereto and may be cancelled by either party upon thirty (30) days' notice. WITNESSETH FOR AND IN consideration of mutual promises, covenants and conditions hereinafter contained, the parties hereto agree as follows: 1) City is hereby granted by District, the right to use one (1) Classroom at GALLINAS ELEMENTARY SCHOOL of providing a Child Care Program. 2) District will furnish utilities and maintenance. for the purpose 3) District agrees to give City a minimum of 30 days' notice if District wishes to move program to another school or classroom. 4) City agrees to pay a monthly rental charge of $200.00 per month, payable on the first day of each calendar month. 5) City shall indemnify and hold District harmless from any liability for personal injury or property damage arising out of the use of District facilities by City pursuant -to this Agreement. 6) This Agreement may be amended or terminated by the mutual consent of the parties hereto and may be cancelled by either party upon thirty (30) days' notice.
