RESOLUTION NO. 6357
RESOLUTION OF INTENTION OF THE CITY OF SAN RAFAEL
TO ESTABLISH A RECYCLING AND RESOURCE RECOVERY
SERVICE WITHIN SAN RAFAEL
WHEREAS, pursuant to the San Rafael City Charter, Article
III, Section 39, the Council of the City of San Rafael may provide for
the collection and disposal of refuse and waste matter, including
recyclable materials; and
WHEREAS, the City Council finds that it is in the public
interest and serves to promote the general welfare of the City to
establish a recycling and resource recovery service for the
collection, disposal, and recycling of metals, glass, and paper placed
at curbside and that such a service will benefit all residents in San
Rafael; and
WHEREAS, certain residents of San Rafael have approached the
City Council and have requested Council consideration of such a recyc-
ling and resource recovery service; and
WHEREAS, the City Council is required to adopt an ordinance
amending the San Rafael Municipal Code by adding Chapter 9.17 thereto,
in order to establish said service and to provide for contractural
services to perform said service and to provide for the frequency of
said service and to establish rates therefor,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael that:
1. The City Council does hereby adopt a Resolution of
Intention to establish a recycling resource and recovery service
within San Rafael;
2. Such recycling and resource recovery service shall be
established, described, and provided for in an amendment to the San
Rafael Municipal Code adding Chapter 9.17 thereto, entitled "Collec-
tion and Disposal of Recyclable Material", which Chapter, in addition
to establishing said service, shall provide for contractural services
to perform such service and shall provide for the frequency for such
service and establish rates therefor.

3. A recycling resource and recovery service shall be
established providing for the collection, disposal, and recycling of
metals, glass, and paper placed at curbside. Said service shall be
available to and shall be used by all occupants of residential
dwellings, condominiums, and apartment houses in the City.
4. The authority to conduct a recycling and resource recov-
ery service, and the responsibility therefor, shall be granted to a
responsible business organization qualified to conduct said service.
The grantee of said authority shall thereafter be the City's official
recycling and resource recovery service provider.
5. A charge system shall be levied whereby each tenant,
lessee, or occupant of any residential dwelling, condominium, and
apartment house in the City shall have access to said recycling and
resource recovery service and shall pay the official service provider
at the monthly rates provided therefor in a contract between the City
and said service provider.
6. The City Council may, with or without having invited
bids therefor, enter into a contract with any responsible individual,
association, firm, organization, or other business entity, whether or
not said entities are operated for profit, for the collection,
disposal, and recycling of metals, glass, and paper placed at curbside
within the City. The term of the contract, rates ofcollection, and
other provisions of the contract shall be provided by resolution of
the City Council.
7. A public hearing shall be held before the City Council
on August 16, 1982 at 8:00 p.m. in the Council Chambers of the San
Rafael City Hall, or as soon thereafter as may be heard, to consider
establishment of said recycling and resource recovery service.
This Resolution of Intention shall be published at least once
in a newspaper of general circulation within the City of San Rafael.

hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted at a regular meeting of the City Council of
said City held on the 19th day of July _, 1982, by the
following vote, to wit:
