A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL DETERMINING AGENCY COMPLIANCE
WITH SECTION 33433 OF THE CALIFORNIA HEALTH
& SAFETY CODE REGARDING SALE TO EDWARD H.
KUYKENDALL, ETAL (A.P. 11-263-20)
The City of San Rafael, hereinafter referred to as City, and the San
Rafael Redevelopment Agency, hereinafter referred to as Agency, having
conducted a joint public hearing upon the above entitled matter upon due
notice, and the City and/or Agency having heard all persons, objections
and recommendations relative hereto, and having fully considered the same,
do hereby declare, find and determine that:
1. WHEREAS, California Health and Safety Code Section 33433 requires
the legislative body exercising jurisdiction in the area hold a public
hearing to approve the sale or lease of any Agency acquired property which
was purchased in whole or in part with tax increment monies; and
2. WHEREAS, the Agency will, or has approved a Disposition and
Development Agreement; and
3. WHEREAS, the City and Agency have caused two (2) public notices
of this meeting to be published a week apart in a newspaper of general
circulation within the area, the first notice at least two weeks prior to
the call of the meeting; and
4. WHEREAS, the Agency has prepared a reading file, in conformance
with Section 33433 of the California Health and Safety Code, which is
available for the public to read at the office of the City Clerk, 1400 Fifth
Avenue, San Rafael, and the Agency office at 1313 Fifth Avenue, San Rafael.
NOW THEREFORE, the City takes the following action:
RESOLVED, the City determines the Agency has complied with Health and
Safety Code Section 33433 and approves the Disposition and Development Agree-
ment with Edward H. Kuykendall, etal. Said Agreement is in substantial
conformity with that in reading files placed with the City Clerk.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a SPECIAL JOINT MEETING of the members of said Council held on
the second day of August , 1982, by the following vote, to wit:

DESCRIPTION
ALL THAT CERTAIN real property situate in the City of San Rafael, County of Marin,
State of California, described below as follows:
BEGINNING at a point on the Easterly line of "A" Street, which point is distant thereon
North 6° 45' East 197.0 feet from the Northerly line of Third Street, said point of
beginning also being the Northwesterly corner of the parcel described in the Memorandum
of Lease by and between Cheda Estate Co., a corporation, and Wells Fargo Bank, a
corporation, recorded December 31, 1962 in Book 1645 of Official Records at page
217, Marin County Records; and running thence along the Northerly line of said parcel
described' in 6aid Lease, South 83 15' East 87.0 feet, South 38 15' East 20.0 feet
and South 83 15' East 48.0 feet, more or less, to the Westerly line of the parcel
described in the Deed from San Rafael Land Title Company, a corporation, to Richard
L. Hibbett, et ux, recorded July 5, 1955 in Book 953 of Official Records at page 427,
Marin County Records; thence along said Westerly line, North 60 45' East 115.0 feet
a
more or less, to the Southerly line of Fourth Street; thence along said line, worth 83
15' West 148.3 feet to the Easterly line of "A" Street, and thence along said line South
6° 45' West 101.4 feet, more or less, to the point of beginning.
EXCEPTING THEREFROM any portion thereof lying Easterly of the boundary line as
established by the Boundary line Agreement executed April 2, 1932 by and between
Cheda Estate Company, a corporation, and San Rafael Land Title Company, a corpo-
ration, recorded May 6, 1938 in Book 362 of Official Records at page 144, :Marin
County Records.
